Question I have... Why wont your premium services, let me pay with my Discover Card ? Hoping for any response. Another question on my mind: I currently have a debt from an old apartment complex that was placed with an attorney's office back in 2008. The attorney's office sent validation of the debt and all monies that have been applied to the initial balance (1,637 minus security deposit, minus). I called the office today (blocked my number) to find out what the final balance was so I could pay off the debt and I was told that it was showing I owed $1900. the rep said there was no record of a security deposit showing as being credited on the account and she offered to investigate but she said she needed an address or phone number (I use a UPS store mail box address as my primary addy and they could not serve me at that addy).



At this point I am feeling the frustration set in because I am making an attempt to resolve the debt however the lack of cooperation on the part of the attorney's office is counter productive to that. I have the paper work that was sent showing that my security deposit was applied to the balance. Should I fax that documentation over to their office or send an official letter of validation to make them send me a list of all charges and credits that have been made on the debt to date? Or, should I attempt to settle the debt for a lesser amount (as most of the amount is interest and fees)? Thank you in advance for any advice given....I don't want to pay a visit to the office and end up on CNN over this...

I'm stumped. I'm not so sure what is the right answer to your question. I'll do some poking around and get back to you if I bump into an good answer. You should email the people at Discover Card as they probably could answer your Discover Card question..

I personally would just call the apartment complex and see if they will let you settle up directly with them. They will often jump at the chance to save the collection costs...

Thank you. No this is not a judgment. They filed a case but could not serve me and the case was recently dismissed. When I called the attorney's office she told me that the balance was incurring interest, court costs and attorney's fees. From putting the pieces of the puzzle together; the apartment complex sent it to a collection agency ( which is on my credit report) and the collection agency sent it back to the apartment complex advising them to send it to an attorney...

I was going to call them and see if they could pull it back in order to make some sort of settlement agreement because I really need to get this thing resolved and I don't have time to play name that balance with them...

It is worth mentioning that you cannot block your phone number from an 800 number.....

Also, I do not know if I would have given them my phone number or address at this point in time. Personally I would have asked them for their name and address and told them they will receive all of the contact information they need in the letter I will send to them.

Are you sure it's really an Atty office?.

Do they have the right to collect?.

If you settled would you have the money to settle in full? (or the full ammount of the lesser ammount you plan to offer)?.

How old is the debt? Is it even in SoL for your state?..

I'm trying to figure out how it's incurring interest if there's no judgment....It's not a credit card.....What am I missing here?.

If the amount is incorrect then how did the attorney "validate" your dispute?.

You DID not receive validation, they did not prove how the apt complex arrived at the balance they are collecting for..

LOL THEY hung up on you! that is too funny, we are the ones usually hanging up on them..

I would sent the apt complex a DV and ask for a FULL accounting, you want to know when you made your last payment and what happened to your deposit and how it was applied...

I'd talk to a lawyer. Specially ones that handle Landlord/tenant issues and possibly as back up consumer rights attorney. As someone stated, there is no judgment this isn't a credit card, they shouldn't be adding on interest. (court costs/attorney fees I can see) Interest NO...

It was a local number so I was able to block my phone number. I only confirmed the address they already have on file. Yes, they are a real attorney's office and all this happened in 2007 so the debt will be 3 years old the end of this year. If they were to settle that would be fine I do have the money to settle but the balance they are giving me is incorrect...

When I first put the debt on debt consolidation in 08 they contacted me and I had explained to them that I had not heard or received anything since I moved out. The attorney sent me a; signed copy of my lease, a list of charges and a statement from the complex )I still have the documentation). I knew I had a balance owe even after the security deposit and the three payments I made on it and I wanted to pay the balance off. When I called to pay the balance off that is when she told me it was $1000 more than what I owed. When I would not give her my phone number and only verified the address in their records she got mad and hung up...

I am coming to the conclusion that I might have to take this route. It is Maryland state law that the apartment complex is supposed to send a tenant a statement of charges and a statement within 45 days of moving out that shows what happened to the security deposit. I never got that. I never heard anything until I got a letter from the collection agency and shortly after a call from an attorney's office when the proposal from the DMP was forwarded to them from the collection agency...
