Quick question: Why doesn't the government give me a sweet 0.25% Lending Tree mortgage loan like they give banks? Many thanks for any answer or 2. 2nd question I got is.. Will try to keep this short. I live in NY state and had a summons served at my home last Monday. I've been instructed to answer within 20 days or a judgment will be filed. This is for a CC debt.



Unfortunately, before I learned I was eleigible for LA, I called the City Court Clerk and was told to call the attorney for the plaintiff to find out how to answer. Of course it turned out to be a stressful conversation of do you want to pay or do you want to go to court. I was scared so I said IF it was my debt I wanted to work something out. (And if it is, I really do.) Here's the problem though. The only income we currently have is my husbands social security check and his very small IRA pension. We just barely have enough to pay our necessary bills and groceries.

I assume if they got a judgment they would go after the house or the car..

I have actively been seeking employment but so far no luck. What I need is TIME and if the debt is mine I will try to pay it as best I can. My husband is terminally ill - on oxygen 24 hours a day - and the stress of all of this is pushing me over the edge. I don't care about my credit rating. I just want to pay whoever I owe money to and NEVER get involved with creditors again..

How can I buy some time?.

Sorry if this is disjointed. I haven't really slept more than 3 or 4 hours a night since last Monday...

That's a good question. I'm not sure what is the answer to that question. I'll do some research and get back to you if I discover an answer. You should email the people at Lending Tree as they probably could give you help..

Most states have a Homestead Exemption, which will protect a percentage of the equity in your home from creditors...

Since this unfortunate woman has her home free and clear, and in her own name, the $10,000 NY homestead exemption will do little good..

How old is this debt? When was the last payment to the original creditor on a regular monthly statement?.

You need to file an answer and notice of appearance,not a validation request..

Don't worry about anything you said to the CA -they can't remember their own lies, much less what someone honest says to them..

Is this the only debt that is in arrears? If not, and you want to get past all your problems, you should consider having Legal Aid help you file BK...

NY's homestead exemption is only $10,000..

And the SOL won't be until 2004..

I really want to take care of this but how do I buy some time?..

According to what I've read though if we file BK we'll still lose the house and his SS isn't enough to pay rent with. Am I misunderstanding something about BK?..

If you own your home free and clear then why not get a home equity loan. I'm sure with a clean deed you can get the money you need to settle this debt..

How bout a reverse mortgage?.

I said I bet - maybe I should have said "wouldn't be surprised". She doesn't remember the debt, doesn't know if it is hers, and she implied that the attorney didn't share any information..."do you want to pay it or go to court" "LA is trying to get it validated"..

It was just IMHO...
