My 1st question is: Why are Lending Tree mortgage loans calculated based on pretax income and not aftertax income? Thanks for any answer or 2. Second question.. If paying an old bill does not re-age the account, when does the newly paid old bill drop off one's cr? As you may know from old threads, I was forced to pay a couple of collection accounts (that were just about ready to drop off) in order to complete my refinance. I'm now clear that the account does not re-age but I wonder when the paid collection account drops off?..

Hmm... I need to find out myself. I don't know what is the right answer to your question. I'll do some research and get back to you if I got an decent answer. You should email the people at Lending Tree as they probably could give you help..

There are actually two possible scenarios, depending on when the account was charged-off. The FCRA was amended in 1997 to specifically state that the seven year clock began from the commencement of delinquency. That is the date of the last payment that was posted to the account, eventually resulting in the chargeoff of the account (i.e. it was never brought current after that last payment). If your account was chargeoff after 12/31/97, then this would apply to you. It wouldn't be the date of delinquency+180 days + 7 years in this case, it would just be the date of delinquency + 7 years..

If the debt was charged-off before 12/31/97, then the old FCRA would apply, and the FTC opinion is that the date of chargeoff plus seven years is the determining factor. So in this scenario, it would be the date of delinquency + 180 days (when the account gets charged off) + 7 years as Mark had stated..

Even though there are two different scenarios based on the FCRA revision of 1997, almost all creditors and CRA's go by the new version regardless, so you are looking at 7 years from commencement of delinquency date..

It doesn't matter if the collection is paid or not, or when you paid it. The original commencement of delinquency date is still the determining factor. It's seven years from that date regardless of what happened at any time after that...

Make sure you have reports that shows the original DLA from before you paid it...

Yes, that is true Butch. This is a fault in the way that Equifax and Experian report their information. They should have a separate indicator for a "date of status" or something similar, but they don't. Therefore, if the creditor or CA updates the account, the DOLA changes and the scoring system reads it as a recent account which kills the score..

I did call Equifax on it, and they deleted it without much of a fuss once I was able to show them the previous reports and creditors records showing the original delinquency date..

Dolly, I would take a real hard look at the dates being reported on the account and get on the CRA if they have effectively re-aged the account due to their reporting of DOLA..

This is another lesson in KEEPING RECORDS OF EVERYTHING! :).

Oh, and I do remember this very well, Butch. It is hard to forget a 100 point FICO drop! :)..

How well I remember. I've gone back to that thread numerous times. Every time I read it I get something new..

I've even referred to it in a cpl posts, and then I never hear another word about it. I think it scares em..

:).

But anyway, yep I think we have an intrinsic violation, much like the one TU has when their system won't allow In Dispute notations...

Thanks All,.

I thought that just having a recently paid collection would be considered a derog. Thus, the derog would start the clock again. According to Eq, the original derog is supposed to drop off in a couple of months. As I just paid the bill off, I thought the new paid collection status,( ie last activity,) would show up another 7 years. I think I'm clear now. The clock will not start over.



Also, I have not deleted all of the old addresses. I thought that since I used to live at those addresses, I could'nt dispute them as incorrect. Is there a thread showing how I can dispute the old address which may result in a deletion of the paid collections?..
