Quick question: Who's does the voice over in all of those Discover Card commercials? Looking forward for any answer or 2. 2nd question I got is.. Long story but I definitely need some help!.

About a year ago I made a dumb dumb dumb decision which I wholly regret now - so please understand as you read my post that I totally know I did a dumb thing. Here goes......

In my previous career (real estate) I signed a ridiculous one year advertising agreement without reading the terms as closely as I should have. STUPID I know but at the time things seemed to be really going well. The contract was for a year of advertising totaling like $7800 I think, in installments of approx $600 a month. I paid the deposit and the first month then the well ran dry so I sent several certified letters stating that not only could I not pay but I was getting out of the RE business so the advertising would have to be cancelled. They sent a few form letters back not really addressing anything that I said but just restating their terms of cancellation - had to be notifed 8 weeks in advance and still had to pay 25% of the contract - which was totally impossible for me. I sent another letter stating that I needed to cancel asap as I would no longer have a re license so it would be false advertising if they continued to run the ads.

Fast forward about 6 months and I am getting calls from Barry Serota and Associates, I have never answered but the voicemail refers my "contractual obligation" with the agency and states that I can call back for a settlement..

Since it is a rather large amount of money I would suspect that BS and A would love to get a judgement, however the deal is that it is an unrealized debt - the $7800 was never incurred like if it was a Discover card account or something. Basically I broke the terms of their contract, but was paid up to the time I requested to be let out of the contract due to getting out of the business..

After working on my credit with the help of this great place I am finally in a good place, I do not want to get a judgment!.

HELP!!!..

Hmm... I need to find out myself. I don't know what is the answer to your question. I'll do some research in Google and get back to you if I find an useful answer. You should email the people at Discover Card as they probably could assist you..

That depends on if the debt was sold or assigned. If sold, yes the CA will settle for less. If assigned, then the CA is going to make sure they get their cut. You can get around their cut by going back to the OC. It just depends on your negotiation skills...

That has definitely worked for me in the past, with a small medical debt. The only issue here is that I did contact them, via cmrr, several times and they just kept sending back form letters and did not reply or respond to anything that I said in the letter.

Thanks again for your advice - I will call the OC and see if I can negotiate a deal. Aahh Im so broke!..

Called, they took a msg and said someone will be calling me back. Dude on the phone said he doesnt know if the debt was sold or not, guess I will be waiting for a call...

From the original post of the OP I did not see where she mentioned that the OC sold the debt. Because of that I went on normal business practice, which is to send a debt to a CA. Therefore, I posted my opinion accordingly...

Yeah at this point idk if they sold it or just assigned it to Barry Serota and friends..... hopefully someone will return my call today and I will find out...

Finally got in contact with someone at the OC ( my fault on not calling back) and they did NOT sell the debt to the CA..

The amount of the entire contract totals $7800, however the advertising was stopped due to my non payment after 12 weeks. That totals up to 1500 - even though I am sure the CA was going to try to collect the whole $7800 because the contract stipulates that the total amount is due upon default.

HOWEVER the OC is willing to take $1000 can call it a done deal - in writing.

Good?..
