Question I have... Who can help me if I suspect a lender of improper Lending Tree mortgage lending practice? Thanks for any response. Another quick question... They told me yesterday that if the 30th day in a dispute is on a Saturday or Sunday, they then have til the following Monday to complete it. I argued with her that the FCRA says 30 days - period. So if it falls on a Sat or Sun, the previous Friday MUST be the last day of the dispute.

I don't know if they are:.

1) just stupid.

2) trained to give these moronic answers.

3) just say whatever pops into their pea sized brains if they think it sounds good at the time..

4) really believe what they tell us..

Good question... I dunno what is the right answer to your question. I'll do some research and get back to you if I find an good answer. You should email the people at Lending Tree as they probably could give you help..

I think that the people answering the phones are.

Just plain morons but they do have some people on the ball. I was expecting a total blowoff of all my chod disputes at TU but it didn't happen. My TU greencards were signed and stamped on 11/25.

And my investigation was concluded exactly in 30 days. I also got the "credit repair" letter...

I sent in a dispute which they received on 11/27. They started the investigation on 11/29. They say they have 5 days to start the investigation. What they have is 5 days to notify the reporter of the info that I dispute it. They have 30 days from the day they receive it to conclude the investigation, and 5 days to notify me after the investigation is done..

So, in reality, my dispute, if you count the day they received it as day 1, should have been done yesterday. If you don't count the day they received it, it should be done today. Not Sunday, which in their minds would give them til Monday..

I need to call them now...

Lkh, calling them won't help. we have the exact same dispute end dates and I spoke to a rep there who told me that the dispute began on friday the 29th, not the 27th, even though I have emailed proof from them that it began on the 27th, and she did say that they have until Monday to complete the disputes, which gives them like 3 extra days, which unfortunately for them isn't in the fcra anywhere. so what to do what to do?..

Don't bother calling. they are trained to give this stupid answers. they are also trained not to think. I spoke with 2 reps, a supervisor, and a manager at Equifax and all of them repead the same thing: we have 5 days to process your request and 30 days to investigate. and there is not a demn thing you can do to change it, shot of going to court of course. One of the reps told me that they have manuals and they can't go against it...

I did call. Specifically, to verify that at 4:25 pm, 5 minutes before they closed, my dispute had still not received a response. I advised the rep to pass this on to whomever she deemed necessary:.

"When I pull my report on Sunday, since you claim the computers update all weekend, if this disputed item is not deleted, I will be filing a lawsuit for the several violations already committed..

1) dispute was received on 11/27, not 11/29 I have cert receipt to prove it. (and now some of you know why it is best to send cert.).

2)extending the 30 day period by 3 days.

3)not notating on the report that this item is disputed by me..

And any other violations I can come up with...

Sweet idea. I think that I am going for the same, but I am not even going to call. monday when I call if the item has not been removed I am going to let them know that I received proof from THEM that the dispute has been started and that they had 30 days from that date to complete the investigation. I am interested to see where this one ends up...

Lkh, I saw in another post that you mentioned sending a letter of intent to sue, what would you list in your intent to sue? would you request deletion of entire investigation or just that item that was verified after the true 30 day period was up? or would you even mention the disputed items at all?..

This was the 2nd time this week I got this rep. She has a serious attitude problem from the minute she answers til the time she hangs up. I have her name...

I'm not sure I follow as I only dispute this 1 item. And, it wasn't something that I really cared if it didn't get updated/deleted. They just piss me off with their blatant disregard for the law. I have actually been done with my cleanup for about a year..

If I had several items in dispute, I would use the violations they committed on the one item to get all the disputed items deleted...

Thanks so much for the prompt response. so technically today was the last day for both of our disputes, should I send the intent to sue monday or tomorrow? okay I know that I am jumping the gun a bit, but I really would like to see some of these baddies go bye-bye..

Sorry, but how would you use the one item violation to get them all disputed. I understand the concept, but I am fuzzy as to how to get it across...

I had this same problem with TU. My 30 days ended on a Sunday, the girl originally said that it ended on Monday, I said nooo it ends on Sunday. When I checked Worthknowing on that Sunday, it was deleted. I then checked TU and it was gone from there too...

You may not remember this, but when I posted the "this board is being watched" thread, the letter that caused that post was from D. Richman. Shortly after I received that letter I contacted him and he did help resolve most of the issues I had..

A few of the issues I had to go thru online disputes because he refused to delete them. I got them deleted on my own. This particular issue I didn't really care whether it was fixed or not. But, I am getting tired of the way they do things. They lie, commit violations daily and it's time someone started something with them. If my item isn't deleted by Sunday afternoon when I pull my report, then I will confer with my atty.

Then sue...
