First of all Where do I find a Lending Tree mortgage with good rates and less points? Looking forward for any answer or 2. My other question... I’ve been reading this board since Oct and have made much headway with taking control of my credit health. I hate to make my first post a question but I’m desperately seeking other opinions on a problem with DISCOVER card inquiries. I'm seeking your opinions if you'd be so kind. My compliments to all here.



I apologize for the length of this but am hoping that someone can offer some help. Also, if you are a Discover customer you should definitely read on for your own knowledge..

I pulled my Equifax report before the new year and found that Disc had pulled two hard inquiries within 30 days of each other without my knowledge. Get this, the reason they give is that they were pulled in response to my making larger than usual payments. In an effort to keep my balances under 20% I decided to bite the bullet and pay it down in a couple of larger payments. I can’t believe that this would fall under permissible purposes. The inquiries hit my score in the double digits. I had just gotten back up over 700.



Here is Discover's denial to my request to remove the inquiries from my CR:.

""Thank you for your recent message regarding the inquiries on your credit bureau reports. Your message was forwarded to me for review and reply..

You stated the inquiries of November 27, 2002, and December 27, 2002, were unauthorized by you. I did review the reason for those inquiries and found the November 27, 2002, inquiry was initiated based on a routine review of the $1600.00 payment we received on November 24, 2002. The inquiry of December 27, 2002, was initiated based on a routine review of the $1343.49 payment we received on December 18, 2002. We are authorized to obtain these reports as stated in the Cardmember Agreement as follows, "We may from time to time review your credit, employment and income records.".

The inquiries were requested by Discover Card for legitimate purposes and unfortunately, we are unable to comply with your request to remove the inquiries from your credit file. We are obligated to report inquiries related to the Account..

Although I understand you are not satisfied with our security and credit review procedures, I hope this information has been helpful. If you have any additional questions or concerns, please contact me again..

I called and wrote Discover several times but as have met with not much more than arrogance and a complete disregard for me as a customer. I have had the card for five years with a good payment history. The account was in good standing when I made the payments..

Why would they pull two credit reports within 30 days of one another just because I was paying the account down? The FICO scoring system is treating the inquiries as if I’m seeking new credit. It’s an inaccurate and unfair representation of my creditworthiness. I am now in a higher interest rate bracket..

I realize that permissible purposes has been discussed here and I've read everything that I could find but I experience much trouble with the search function. Would anyone here like to offer suggestions or thoughts? I’d really appreciate it..

This is what I’ve done so far:.

Sent letters to Discover including one certified mail with the FCRA excerpts as suggested here. I requested that they remove the non-permissible inquiries or I will sue for damages..

I filed a complaint with the DE Better Business Bureau,.

I filed a complaint with the FTC,.

I sent an email to an attorney who is currently handling a class-action lawsuit against Discover for illegal activities regarding payment date reporting..

It looks like Discover is just going to give me the run around re their “Cardmember Agreement baloney, "We may from time to time review your credit, employment and income records.".

It looks like I’m going to have to sue them, I’ve never done this before, can anyone give some thoughts advice. I could just wait the 12 months until it doesn’t affect my FICO score but there is a real principle here. Discover seems absolutely without concern that they’ve lost a customer. They seem so self-assured in their right to pull a hard credit report because I made a larger than normal PAYMENT on an account in good standing which cleared immediately..

In fact, in the second “large” payment of mine (over $1000 is how they categorize it) the money had been in their account a full week when they pulled the hard inquiry in response to said payment..

Ps, they also pulled a hard with experian on the same day as the second inquiry but I haven't even approached that one...

Hmm... I need to find out myself. I don't know what is the right answer to your question. I'll do some Googling and get back to you if I find an decent answer. You should email the people at Lending Tree as they probably know..

I think I know exactly what they are doing, because Chase did this to me about 10 months ago. (except they pulled 1 inquiry)..

I made a large payment to bring my balance down, and poof, they pulled a hard inquriy..

I called to complain (I shoulda got it in writing), and was told they have a right to pull my report to see if my 'credit situation' has changed, because I had never made such a large payment. (HUH?!!!!).

I know they pulled my report to see if I had applied for another card. (to pay them off or down)..

I betcha they would say I was 'taking on more debt'..

They knew by pulling my report, it would decrease my score. Also, this decrease in score would make it impossible, (in their opinion) to get another card again..

I immediately fired off an '.

Intent to sue.

' letter, and I wrote to my Attorney General, and miraculously, the hard inquiry left, and they gave me a credit limit increase (bribe) LOL...........

I don't use the card anymore, I just keep it for age..

Oddly enough, Chase does account reviews, so I know they did that on purpose..

I wonder if this is what Discover (wrongly) did to you?..

Discover is just a bunch of scumbags, regardless of what they do. I still do not know how they remain in business. Wish they would just die..

I would suggest paying off the card and closing it. Chances are, you will be asked to speak with Retention. Maybe they can help. Otherwise, tell Discover to go **** themselves..

This sounds very similar. Someone else suggested that they might be trying to see if I'd applied for more credit to pay it down. I didn't. I just had a less than festive holiday season..

What irks me even more is that they did it twice in one month for two different payments over $1,000..

This is the letter I sent which generated the response I posted in my first message here. It seemed to have no effect. I mailed it to their executive office certified mail as well. Thats what the CSR told me at one point if "I didn't like it". No name, just some black hole to send my request to..again..

This is my second written request that DISCOVER remove two inquiries as reported on my Equifax report that were not permissible..

I did not give either a verbal or written permission to DISCOVER to furnish a consumer report on the following dates:.

November 27, 2002.

December 27, 2002.

As a result DISCOVER is in violation of the Fair Credit Report Act:.

604. Permissible purposes of consumer reports [15 U.S.C.1681b].

Please remove the credit inquiries on my Equifax dated November 27, 2002 and December 27, 2002. If you do not you will be in willful noncompliance with the FCRA and subject to penalties under the Fair Credit Reporting Act as follows:.

FCRA section 616. Civil liability for willful noncompliance [15 U.S.C. section 1681n]..

"(b) Civil liability for knowing noncompliance. Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall.

Be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or $1,000, whichever.

Is greater.".

I reiterate, please provide verifiable proof that you had permission to furnish a consumer report on me on November 27, 2002 and December 27, 2002 or remove the inquiries from my Equifax consumer report. Each inquiry has resulted in a 5 to 15 point drop in my FICO score. Due to your unauthorized inquiries I have suffered unreasonable damage to my score resulting in higher interest rates when qualifying for credit..

It's difficult for me to understand or believe that DISCOVER has refused to date to one, act in a reasonable manner when dealing with a customer and two continues to be in willful noncompliance.

With the FCRA..

I thought this was pretty close to an intent to sue but I'm not sure on the wording as such. Also, I appreciate your advice re the DA..

They behave as if they can do anything they want knowing full well that they're damaging a good customer. It's pretty amazing..

Seriously, Discover is really bad at record keeping too, because a poster said she disputed an old Discover account, and they started to send her statements!!!!!.

Don't use it...PAY IT IN FULL and keep it for age!!!.

I'm fighting DISCOVERCARD for CREDIT LIMIT.

Stated as $17,500~BALANCE atated as $17,500 (100% MAXED) for the.

George and Mecro, I agree. There was a point that I was suggesting to them that they were losing a customer but they didn't seem to care. I transferred what was left of my balance to my BofA VISA and will stick the card in a drawer..

I don't want them to get away with it though so i'm going to try to send my complaint to anyone I can find that might be relevant and if I don't get the answer I want in a couple of weeks I'll definately file a claim. Just not sure how at this point. Has anyone followed up a non-pp with a claim, lawsuit? So far Discover is being oddly stubborn so it looks like I may have to go that route..

It's funny, shouldn't they pick a better hill to die on?What trouble is it to them to remove those bogus inquiries to keep a good customer??.

Manequinne, yeah, it's a real sign that I know I'm not being listened to when I repeat myself. my logic is, perhaps if I say it such and such way it'll get through LOL...

Welcome to the club. I have been screwed by their inquiries too. PFB wont work .. the guy who answers them is another CR, he will not be able to help you. I tried calling/bitching/abusing the managers every other day-no result, sent letter to their Credit disputes and CEO, filed complaint with FTC, filed complaint with BBB nothing works. keep us posted if you find a way to get it deleted...

I think you have a good case for taking them to court. They must be stupid. The person who wrote that letter is a moron for real. That person basically gave you the evidence you needed to take them to court. I can't help you with procedures for taking them to court but I can tell you with relative certainity that you have a very strong case against them. That letter is your ammo..

Since I don't like to waste my time with court. I would suggest that you write a demand for payment letter to their legal department and head office. Demand the full $2,000.00 and state the reasons why they own you. Include a copy of that letter..

The card member agreement would not protect them in this case. I am very sure of that. Give them choices..

A. Sufficiently(sp) prove permissable purpose. That original response does not prove PP..

B. Have both inq. removed immidiatly.

C. Pay the $2,000.00 and remove both inqu..

Give them 2 weeks to respond..

If not satisfied with response. Send a final demand letter on option C. Let them know that court cost and fee would be added plus attorney fee if applicable..

I think if you write the demand letters well, you would get the inqu. off without court..

Any moron would know that they were out of step to do what they did. Problem is that most people don't look at there report often (me included) so they feel it's right because people don't complain..

Just wanted to say that their behavior is outrageous. Discover pulls ARs all the time so they should know your "credit health" w/o pulling hards. My understanding is that the permission to review your info at any time MEANS ARs and that hards come from requests BY you to the credtors. At least that's more or less what the verbiage of two sections on the CRs claim. And at the end of the day-why would they care so much not to just recode?..

I know you asked them to delete. Have you tried asking them to recode the inquiries to AR? I just sent out a couple of letters to that effect, will see what happens...

You brought up an important distinction. In my experience I have had NO luck w/ hard deletions but have done pretty well when asking for a recode to an AR w/ the explanation to the company as I've stated above.

Got the inquiry removed. Kept calling the CSR they got fed up with me (:)) and transferred to a dept called credit services(?), the CR at CS initially asked me to contact their Credit bureau disputes dept by mail. I Informed them that I have already done that but never heard back, the CR then transferred me to a manager who deleted the inquiry. I guess there are a few people even in the CS dept that have the authority to update Credir reports they just dont want to help the customers. It took 3 minutes to prepare the update request and send it to the CB, those idiots spent 3 hours on an issue that could have been solved in 3 minutes so much for their "first call resolution" motto .Good Luck in finding the right person...
