First of all What's the song on the Discover Card ad that ends with with"to be continued"? Hoping for any answer. Second question of mine... Apologies in advance for the long read. First off, I'm in Texas. I've been dealing with my last major baddie, an electric utility account that was charged off in November 2003. The OC is TXU Electric and this has not been placed with a collection agency. |

Why do you contend this was 'truly not yours?'.
Were the letters you sent to TXU specific in nature, or were they the generic ones found around the web?. What is the status of the PUC complaint? Did you request a hearing on the merits?.. |

Uh yeah, that's a serious FCRA violation(s). your first step now is to send them a full C&D, then sue their asses. enjoy your compensation..

I didn't say "truly not mine", I said "truly inaccurate information" meaning the information contained on the trade line was inaccurate, not that they did not have a right to report said trade line. I apologize for not being clear..
My communications with TXU have been very specific. I have pointed out the exact problems with the reporting, and mentioned that they are in violation of both state and federal laws. Do you think I should now draft a specific letter to their general counsel, pointing out every violation, and suggesting a settlement (deletion of the trade line means more to me than money)?. The informal complaint is in the early stages and only about a week old. I have read the procedural rules for a PUC complaint, and I believe they have 35-days as per their rules in order to do an investigation. If they don't investigate or I disagree with the PUC ruling, I can file a formal complaint and request a hearing in Austin. Austin ain't THAT far from Dallas!.. |

I would like to stick with Texas state laws, if able. I don't think it would be a good idea to C&D an OC that I currently have a investigation with. They may have some claim to the PUC that I didn't cooperate with the investigation if I do that. I thank you for the reply however..
Re: the "re-aging". While there is a new account reporting that was "re-aged". I was talking about the monthly "updating" with the current status to the CRAs. Are you sure about this? Can anyone chime in on this subject? I DO know that the report "double-reporting" is a huge no-no, and I have them on that.. I have understood that Capital One are a big abuser of the "update status (CO or 90+ days or whatever) every month so the derogatory looks fresh" method of tanking peoples' credit. I can't find the thread right now, but I think I recall reading that monthly updating is allowable both legally and by industry reporting standards. (I'll have to check the manual and reply later)... |

They can update monthly if they choose.. it's the same as updating a good account every month as paid... they just update every month the last status ... trust me it annoys me to and I believe it shouldn't be legal but until the country gets a much needed reform on the CRA's - not gonna happn.
Cap1 is the biggest user of the above as you said... trust me I got three of them on mine from Cap1.. |

What ever happened with this OP?.
I have a TXU charge off for just over $700.. My first couple year in Texas were a desperate fight for mere survival and I probably owe them something, but for the life of me, I can't imagine it's $700 and if it is what I think it is, it is probably coming up on 7 years anyway.. After looking at my report, it looks like this was electric service at a home I rented. That has to be at least 3, possibly 5 months of electricity and I can't imagine how I might have racked up that much without them turning it off.. Strange, but I don't think I want to go poking around at the moment... |

Depending on where in Texas you were and what time of year it was, $700 could be as little as two months of use. In other areas of the State, it could be more than a half a year...

, unfortunately... I won't give specifics.... What I can do is to suggest that you listen to anything centex. Has to say (search is good here), obtain hard copies of your reports, and after disputing with the CRAs if any "reporting improprieties" are found, bring it up with any government bodies that might regulate your utility... |
