Good question... I dunno what is the right answer to your question. I'll do some research in Google and get back to you if I bump into an anything. You should email the people at Discover Card as they probably could give you an answer..

Are they still actively tryin to collect?.
The FOAD letter would work in that aspect, but we know it won't get the deletion, which is the main goal.. I dont think a 623 would get it either, unless you wanna make them hang themselves and use that to your advantage.. Hang on....You could do a 623 straight with LVNV, as we know for a fact they won't respond... |

Did all that when I complained to the AZDFI...... AG won't take it unless the AZDFI refers it to them..
AZDFI is the AZ banking commision which regulates and lic. CA's in this state... |

Consider a dispute with the South Carolina (LVNV's home state) attorney general. Worked for me. Worked for others here (which is where I got the idea). No guarantees of course...

Honestly, what I did when it came to LVNV was hit them with a basic 623/jackattack style letter..
I have a thread around here (I beat lvnv) or something.. Anyway, I would hit the CRA's with:. This is not a factoring acct. There are no 1 month terms. etc etc.. Then I'd hit LVNV AND RESURGENT with the same letter. Also show on the CRA letter that you Discover credit card the disputes to the CA's.. My letter to LVNV/RESURGENT would basically list all of the fdcpa violations and fcra violations and list the Maloney? case that clearly states that LVNV is a DEBT BUYER AND A COLLECTOR. That they are KNOWINGLY reporting false info to the CRA and have verified false info, etc etc.. Copy the letter to your AG, BBB, SC BBB, and the FTC.. Http://creditboards.com/forums/index.php?s...297&hl=lvnv. They do cut and paste lettered replies back to the BBB but keep repeating and hitting them with more info each time they try to bow out. I would like to do another FTC onlline dispute, but it will have to be concisely written; they limit the # of spaces .. How bout if I "Jack attack" the CRA"s thru the FTC consumer sentinel site. Along with an accusation of collusion with the JDB to bypass the FDCPA and FCRA by;. Allowing "inaccurate reporting of invalid accounts by JDB's who are debt collectors under the FDCPA.". They have purchased not an account, but a chose in action; a chose in action can only be claimed or enforced by action ( lawsuit). And this alleged chose in action is time barred.. It was not purchased in good faith and fair dealing, Banks do not "factor" their debt for pennies on the dollar.. LVNV funding is nothing more than a shell corporation which collects debts for sherman financial group, and to provide asset proctection from FDCPA & FCRA claims for same.. If the JDB is an assignee, they cannot reset terms of a chose in action, unless the consumer agrees in writing to it.. I never agreed to an installment account, so there could not possibly be any terms of one month.. CRA's just allow anyone with a reporting subscription to report anything they want, regardless of how illegal it is because they want the cash... |

I'll have to read your thread again.... I've been concentrating on AZ RCP's all this time and not FCRA disputes..
I guess I could try SC consumers affairs and the SC BBB.. What about the SC banking commission?. Thought somebody had luck with that; they are implying they are a lender with the installment notation.. I still like the Idea of a jack attack through the FTC site; they automatically relay all complaints to the CRA's for investigation,. And I would say an "entirely different staff" handle the FTC complaints than those who answer "consumer disputes" sent in CMMR.. Bet they don't answer with Automatic dispute codes to the FTC.... !.. |

Ideas.....
1) Are they licensed to collect in Arizona?. 2) Have you checked Arizona state law to see if an AG complaint may be appropriate?. 3) Have you tried the BBB?. 4) Have you check to see if they are a member of CCA?
