First question I have is What kind of Lending Tree mortgage should I get? Many thanks for any answer. Another quick question... Hello,.

I filed a complaint w/ the BBB against a CA for not responding to my 3 "nutcase" letters demanding validation. The BBB finally got the CA to respond. So I got a letter from the BBB w/ the CA's response to my complaint..

The CA's response says:.

"I.C. Systems maintains that the information it provided to the credit reporting agencies about the account is correct. I.C. Systems sent the validation notice to the consumer in April 1999. She did not exercise her validation rights at that time. I.C.

I.C. System has complied with all laws. Not only will it vigorously defend any action brought by this consumer, but it will bring counterclaims if the consumer brings suit in bad faith and for the purpose of harassment.".

I.C. System attached a print out w/ my name at the top of the page and then an account summary. The print out is a photo copy. It is not on letterhead of the dentist (OC) and does not have my ss# or anything else to identify me, except for my name. In addition, I never received a letter from the CA in April of 1999..

How can I fight this? I researched proper validation and it did say that the account back up needed to have an account summary (debt, finance charges, etc), and show that this is your account by having a cancelled check from a previous payment (which they do not have)..

So, the BBB's letter says that if I do not agree w/ I.C. Systems response then I can write them back and let them know and they will contact them again w/ my continued dissatisfaction..

I'm just searching for some advice on how to respond to the BBB and how to get them on this form of "validation"..

I'm stumped. I'm not so sure what is the answer. I'll do some research in Google and get back to you if I bump into an useful answer. You should email the people at Lending Tree as they probably could answer your Lending Tree question..

First, you can deny they ever sent you anything in 99. Ask for proof of mailing. Next, the FDCPA says if you fail to request validation within 30 days of the initial notification, they can assume the debt to be valid. It also says a court may not take failure to respond as an admission of liability, nor does it say anywhere that if you don't request validation withi 30 days of initial notice that you lose any rights to request validation later..

Further, what they provided proves absolutely nothing, zero, nada, zilch...

Hmmm~ Well, first of all, don't let IC System's letter scare you. They are trying to get back at you with a ton of mumbo jumbo. Write them back (and this time leave the BBB out of it) and state that you NEVER lose your right to validate a debt..

First, state that you would also like some proof from them that they sent you an initial letter letting you know your rights and proof that it was delivered (e.g. do they have a CRRR?). Tell them that IF they did send a letter, they did not make an honest attempt to locate or contact you to let you know of the debt. You probably never knew of the debt until it was too late and was littering your CR..

But that doesn't matter because....

The FDCPA states that if a consumer does not respond within the 30 day time limit, the collector may determine the account as valid. However, it also clearly staes that "the failure of a consumer to dispute the validity of a debt under this section may not be constured by any court as an admission of liability by the consumer." A non-response does not mean that you have admitted to owing the debt in question..

Per the FCRA, you have the RIGHT to request that furnishers of information to your credit reports verify all inforamtion reported ADEQUATELY. They failed to provide any proper documentation to you..

So, screw 'em. Send them a letter stating what I said above, tell them that they must provide you more adequate validation. Also, state that you would also like some proof from them that they sent you an initial letter letting you know your rights and proof that it was delivered (e.g. do they have a CRRR?)..

Question: Did they place the account in dispute on your CR's? If not, violation 1..

Also, do a search on IC Systems. Many posters have gotten them under control. You must know your enemy before the battle...

Great! Thank you so much for all the information. I.C. Systems has been the biggest pain through out my Lending Tree credit repair extravaganza. They have ignored every attempt I have made to get them to validate and show me proof for this account. They have not put this item in dispute, only the CRA's do when I dispute through them, and of course, I.C. validates every time..

So I will send another letter to I.C. Systems and should I send a letter the BBB telling them that this is not resolved and I am continuing to get what I need from them?.

It's been over 3 months of writing letters, which they ignore, and disputing through the CRA's. I'm actually working on the letter right now and I will post for feedback. It's so hard to detach from being emotional and telling them what pigs they really are...so it's taking me a bit to get it together..

I want to eventually take this to court if need be, but I want to try every possible angle first...
