First question I got is What is Orchard Bank Gold Discover Card? Many thanks for any comment. My other question... Ok, just got a phone call and wondering if I have any options here..

The original creditor is Circuit City - Chase the people calling me say they are 3rd party collections and the company is Enhanced Recovery..

The info they gave me was the account was opened over 10 years ago and last paid over 2 years ago. I know we have had a Discover credit card card and I thought it was paid off. I of course, will be going through my paperwork this evening at home but had some questions in the meantime..

The company expected me to just settle over the phone with nothing to show that this was a valid debt. The person I spoke to had spoken to my husband and she said oh he verbally validated the debt. Can you even do that?.

Also, I requested paperwork to show who the debt was with, names on the account, etc and she told me that was fine and good we can request that but unless I agree to a settlement today, I would owe the full amount plus interest but if I took the settlement they would still send the paperwork but of course the decision to accecpt the settlement had to come today only. Then it was handed over to a "supervisor" to reiterate it was a today only deal..

I was just wondering if I had any options with them at this point.....shoudl I send them a letter requestiong all the information? Wait on their information and if it is a valid debt then be responsible for all in full? Dont most collection agencies want to at least get something, even if it isn't the full amount?.

Hmm... I need to find out myself. I don't know what is the right answer. I'll do some research and get back to you if I bump into an good answer. You should email the people at Discover Card as they probably could help you..

Send them a DV with a limited C&D. Stay off the phone with them, it's clear they lie...

This..

If s/he calls again, politely ask that they send their claim for their alleged debt in the mail, and you will respond accordingly, and then hang up..

When/if you get that, send a DV..

If you don't after 10 days or so, DV them anyway to CYA..

Thanks, they even went as far as to say my spouse said we are divorced and they would turn it over to the police for fraud as my spouse said it was opened by me under false pretenses...! GEEZ. I know that was not said, I did not appreciate the threats...

Those threats are also illegal. Get them on tape and they'll be paying (with Discover card) YOU...

How do I do that? Is it legal for me to get a hand held tape recorder for phone conversations? Do I need to disclose that I am doing that as well?..
