Or should I just fire up regular envelope by First Class?. I know what you might be thinking - this guy never stops! ;). LOL, I think a regular business envelope with that nasty CRRR sticker commands more attention. Everything gets lost on a big Priority Mail envelope..
You're turning me into my mother: The instructions say to mail it by regular certified mail with return-receipt requested. :). Doc. P.S. Don't use a nasty green envelope because green is the color of envy and you want them to be envious of your bravery. Don't have a Nepali sherpa deliver the letter because that way you'll be sure that it gets delivered. Don't stir your spaghetti with the envelope for that casual look. I got the green card back which was signed on Nov 25th. I have yet received any form of reply. I know, I know that I should wait another 3 weeks but hey, shouldn't they be scared alread? LOL..

Well, something starts to be happening..
This morning I went to Equifax Credit Watch and noticed a tradeline notification. Yes, you guessed it - Associates/Citi. There is no inq but they changed my status from "N/A" to "Closed by credit grantor request", leaving the late payment as it is - "some unknown dates". I spoke to Equifax and was told that by doing that they did not obtain any form of my file and nothing else had been changed.. I checked TU and nothing there either.. It has been almost 3 week since they signed the green card for the nutcase letter and except that, no reply whatsoever.. Do you think they are f***** with me? PsychDoc?. Thanks.. |

So, does anybody know if they can "update" my file after the account had been closed and paid for over a year? Seems like they want to touch it and see what's in there but we know they can not.. So, is it all right for them to do that?.. |

Actually I just checked and even though the EQ rep told me the credit grantor did it, seems like they were the ones who actually did that. See the mark for the day the change was made:.

As long as they are reporting, they are responsible for the information being reported..

They stopped reporting long time ago as I said the account was closed in 12-1999 and then paid off in 11-2000. Now, probably after receiving the letter they changed the comment field from: N/A to Closed at credit grantor request, but they did that after a year since they last reported..
OF COURSE is NOT ACCURATE. Isn't that's why I sent them the "nutcase" letter?.. |

Well no, they didn't stop reporting long ago if it is still on your credit reports..
Tradeline on credit report(s} = reporting.. OF COURSE is NOT ACCURATE. Isn't that's why I sent them the "nutcase" letter?. OF COURSE, silly me, is that WHY you sent the nutcase letter?. If you do some research, you'll find that inaccurate reporting is NOT the intended use of Doc's nutcase letter.. Sassy.. |

I concur.. Butch,. I love it when you quote Sun Zi (tzu).. I wrote my college entrance essay on his techniques and their applications to games of chance i.e. poker, roulette, etc.. After reading the original chinese in college, I can see why there are 50 interpretations of his and other ancient chinese text. Ancient chinese is very vague ie (to your quote) " war, not fear. fear bad".. |

I would just like you to take a look at the letter I put together (it is a Sassy's sample along with some minor additions from other letters found on this board). Please forgive me for doing that, but I'm not so good in writing such letters (english is my second language), so it may still need some revisions..
Here it goes (goes to the OC):. To Whom It May Concern:. This letter shall serve as formal notice of my intent to file a lawsuit against. Your company, due to your blatant and objectionable disregard of the law.. Over the course of the past year, I have been unsuccessful in my attempts to. Have you resolve the inaccurate information you are reporting against me to each. Of the CRA's. I have disputed this information with the CRA's on numerous. Occasions and have directly communicated with you (list summary and attach copies).. I’m sure you are aware of the consequences in violating the Fair Credit Reporting Act. As well as the multiple violations your company is now responsible for. If. Not, let me point them out for you:. The FCRA requires you, as a furnisher of information, to provide accurate,. Updated and verifiable information only. I have requested verification of the. Information you are providing and you have not responded to my request.. The FCRA requires you, as a furnisher of information, upon notice of dispute, to. Update those tradelines to reflect that the information is disputed, you have. Failed to do so.. Hello again. Just wanted to report what's happening..
I sent an intent to sue letter 10 days ago with 72 hour notice. They ignored it. The very next day, I fired up a fax to the exec office saying they have 24 hours or I fully proceed. They ignored it.. I filled a complaint with BBB, FTC and will contact the Attorney's General Office on Monday and go to small claims court to file a lawsuit.. We thought that they would take care of my demands by now, but seems they want to pay $$$ :). Anyway, just thought you may want to know the status... |

I have one question. There seems to be confusion (court employers) as far as which court to file the law suit in. I was advised by members here, that I should do it through Small Claims Court as the amount I'll be suing for is less then $5000. Anybody knows anything about it?.
Also, I filed a complaint with the Attorney's General Office and they said they would sue them on my behalf and other's and of course follow up on that.. Very nice people.. Anyway, please let me know what you guys think about this Small Claims Court issue.. Thank you so much.. Seems like everything is going straigh to court. Do you think they will want to settle now, or will they take it to court?.. |

Wow, damian, this thread has it's twists and turns! I've not read this since my last response a few months ago, and there have been a lot of great comments in the interim. I have to tell you that I intended the Nutcase series for use with fully paid accounts (per my postings and the FAQ, etc.), and when I responded to you I mistakenly assumed that this was your application as well. I do understand per the subsequent discussion that some have apparently used the letter with unpaid accounts, but that's entirely beyond my scope of understanding and experience. You are clearly blazing a new trail, so I eagerly await your results..
