I would like to know the answer too. Anyone here know what is the answer. I'll do some Googling and get back to you if I bump into an anything. You should email the people at Discover Card as they probably could answer your Discover Card question..

Ok.... Overshadowing could not have happened.... Got ya..
What about the "final notice" and "last attempt." All the collection letters I ever received had the typical, "pay now to avoid further collection activity." Just found their wording strange, thats all.. My wife is looking into the debt, must be from when our child was born this past summer. We have excellent insurance and shouldnt get a bill for anything. This is the first letter we can remember getting regarding this debt. Ill handle getting the debt cleaned up.. The CA's wording just seemed to back them into a corner, no?.. |

If it was from a pregnancy, then there is no telling HOW many professional entities had a piece of the financial pie. It is entirely probable that someone was not included in insurance distribution or even the filings. Anestheologists are one of the most commonly overlooked as near as I can tell and in some cases, it is even a separate entity of the hospital necessities section for the various meds given throughout a day. Could even be the OB-GYN who stuck their head in the door as they were on their way to play golf on the last day of the stay....
IMO, yeah...but not a corner I would want to see someone coming from, as the next option would likely be litigation (a common step being taken by many hospitals, especially county and state-funded facilities)... |

I was thinking this CA will either have to.
1. Go away forever. Or. 2. Litigate. I respect your professional opinion centex, thanks. What happens IF another letter comes from this CA demanding payment? What then? Could they label that letter their "FINAL ATTEMPT #2.". One thing I learned from having a Consumer Rights attorney is that if a CA sets a deadline then they better follow through or the deadline becomes a unintended action (threat). This CA just set a deadline... |
|
I think you should send them a letter telling them that you appreciate the fact that they have made their FINAL ATTEMPT..
JUST KIDDING, people. Kidding... |
|
CF, I would love to send that letter.

All that tells you is that they don't file in federal...and I would not expect them to. Filing fees are typically lower at the State level, not to mention attorney hourly rates are often lower for State court as compared to federal.....

I read your reply in my PACER thread and deleted over here before you posted..... Any place I can look up State level filings?..

County clerk or District clerk's office. You might get lucky and they will be online, but if not, most will have terminal access in their respective offices.....

I looked up the CA name and put in dates from 1/01/09 to today and didnt find anything..
