First of all On a UBS Discover Card, where is the billing adress? if it's on the card? Thanks for any comment. Another question on my mind: Ugh.... this is going to sound super irresponsible (because in part, it is), but it is what it is..

In 2007, I used my GEMB/Care Discover card to finance laser eye surgery to the tune of $3,400. The card offered 0% financing for the first 18 months and (because I didn't think I'd need more time than that so I didn't look ) 29.999% after that..

Minimum payment was $85, and due the 9th of every month. I get paid monthly on the 15th. I called GEMB and asked if I could pay a month in advance and have my due date switched to the 16th of the month. They said that it would not be necessary as a late fee is not occured until the payment is past due for 7 days. I said I'd like it changed anyway and the representative said he would do it but it wasn't necessary. I now think he blew me off, AND was lying - or just incompetent..

At any rate, I setup an automatic payment of $125/mo. to be paid out of my bank account on the 15th of every month so I'd never miss a payment..

$125 x 18 months = $2,250. I planned to pay the balance of $1,150 on the 18th month. I setup my GEMB account so that it was "paperless." I only received two separate emails a month from them:.

1) a "Your online statement is ready for viewing" email which was a form letter with ZERO account specifics.

And.

2) a "Your payment has been received, thank you" email which said nothing else regarding the account except that they got the payment..

(Here comes the irresponsible part).

I was recieving these two emails every month and was convinced that my payments were going along as planned. I neglected to check my account balance because every month I got the "payment recieved - thank you" email..

Eventually, it became so commonplace that I forgot about it. Fast forward to last month when I realized that I passed the 18 month period. It was December of 2009, exactly 26 payments later. 26 x $150 = $3,250. That would leave a balance of $150 if I hadn't been acruing interest. I immediately had a panic attack and figured 7 months at 29.9% couldn't be too horribly bad as I was making payments over the minimum balance, so I check my account..

** I HAVE BEEN CHARGED A LATE FEE ON MY ACCOUNT FOR ___EVERY___ MONTH SINCE IT WAS OPENNED IN 2007 **.

After 26 payments totalling $3,250 on a $3,400 account my balance is $2,800..

The late fees killed me.... they were $40 of my $125, every month, and then when the 18 months were up, the balance was much higher than I anticipated and the 29.999% was applied to that and killed me again..

I called GEMB customer service and explained the situation. They transferred me to an "escalation specialist." I don't know if this is an automatic thing when the regular reps can't help, but I was never rude, never raised my voice, and never used any explatives..

Anyway, this "specialist" says his computer only lets him see back into my account for 12 months... I find this highly unlikely. I tried to explain to him the situation, and ask him, "who on earth would make 26 payments in a row, late, by the exact same amount of time, on purpose???? It's obviously a misunderstanding...".

...he barely tossed me a bone. He creditted me for 6 months (out of 26) of late payments..

My balance, which should be ~$800-1,000 is still $2,550..

He told me if I needed further assistance I could write a letter to "GEMB Presidential Correspondance." I did this, explaining the situation, and I received a form letter in the mail today saying, "After reviewing your account, we are unable to comply with your request to remove the requested fee(s). Please refer to your Discover card terms..etc, etc...".

Is there anything I can do? I paid over the minimum payment EVERY MONTH with good intention. I was lied to buy a representative that I can't prove on day one. What recourse do I have?.

I'm stumped. I'm not so sure what is the answer. I'll do some research and get back to you if I find an useful answer. You should email the people at Discover Card as they probably could give you help..

NEW INFORMATION!!.

I knew I wasn't stupid enough to believe that "grace period" crap. I'm usually much more savvy..

GEMB's customer service reps say they don't have access to further than 12 months previous in my account but I got one tonight to tell me what went on (somehow this one magically did....).

I had a due date of September 9th. I paid before the 9th and then setup automatic payments starting September 16th onward. That would put me in the clear every month..

What the rep told me was that SOMETIME in early 2008, they changed the billing period from 28 days to 23 days. My account was set up as "paperless billing" so I never received a notice. She said it would have been noted on my electronic statement online. I *KNEW* I checked it the first couple months. After checking it for 4 months and seeing that everything went to plan every month I stopped checking and just made sure I was getting the "payment received" emails..

Paying the monthly payment 5 days into the period made my payments "late" for the next 2 years because they changed the cycle from 28 to 23 days!!.

Is there any recourse from that? $2,500 is a lot of money to me.... if I knew a lawyer that would help me pro-bono would I have any ground to stand on?..

A rather extreme case of what they hope happens (and in this case helped to happen) and you fell into the trap, don't get me wrong- it sucks and it sounds like you did almost everything you could to prevent this outcome except checking your statements religiously which it is incumbent upon you to do each month..

IMO your best bet is to escalate with GE and be sweet as honey until someone there agrees to help further..

IIRC there is something about requiring a minimum of 25 days in a cycle in the CARD act going into effect next month, so the timing is off for legal recourse afaik...

Boostd4, this is a really crappy situation and I wish you all the best. Thank you for sharing your story, though. It will help drive a very important point home to others who brush aside their statements each month..

My 89 year old grandfather had a similar thing happen at Lowe's. For 2 years he made his payment on the 3rd of the month when he got his social security check, in store, because when he opened it the due date was the 10th, IIRC. They changed the due date on him and he never noticed. 2 years of late payments!..

At this point, you are at the mercy of the GEMB Goodwill Fairy. If she happens to be at work the day you call, you will get this done. If she doesn't, you won't..

With that said, in my opinion GEMB has already went above and beyond by crediting you back 6 months of late fees. I look at every card I have once a week...even the ones I know I haven't used..just to make sure something like this doesn't happen...

This is exactly why I NEVER do automatic payments. My wife had the same issue, so now she has about a dozen 30 day lates on her report.... all because they changed the billing period and she never read the statement...

Luckily, the first 18 months were 0%. Basically from Oct 2007 to April of 2009..

I have been paying (with Discover card) 29.99% from May of 2009 until current..

Finance charge is $70/mo..

I'm going to use my tax return to pay the balance off in full next month...

This is another case where I have to say, Bank of America has exceptional banking software..

"E-bill Initiated Payments.".

Basically, I give it my Discover credit card username and password, it downloads my bill, and pays it on it's due date. There are a lot of protections and settings, but that's the gist..

I use it on my HSBC, Sprint, FPL, Comcast, etc..

GEMB/Care Credit is evil! lol.

I had to have some emergency dental work done back in 2008 and was talked into getting a Care Discover card by my dentist to pay for the work that had to be done, I was approved for $5000 and used $3,400 and was making my payments, never late always paid over min amount due and thought once I had this paid off it would be a good card to have in case of emergencies. I was notified after a year of having the card that the account was closed, never given any explanation as to why just that the account was closed, calls to customer service didn't help no one seemed to know why it was closed but had all sorts of possible explanations for it. Anyway I will be adding them to my BK...

I like CareCredit and have had no issues with them. Pay your bill on time, check your statement monthly for changes, and make sure you pay off the balance before the promotional period ends and you should be fine...

Your situation really sucks. I hate those situations where it feels like you've been punched in the stomach. Please don't give up the fight easily, I know you played your part in the incident, but never give in so easily. I would try posting on planetfeedback and see if the situation changes and/or keep contacting CareCredit about it...
