Quick question: Is Tribute Discover Card in Newark NJ a scam? Thanks for any comment. Second question.. I checked my credit report today and I have a civil judgment from a land scaping company I have never heard of back in my home state of maryland.. |

So I found out that there was a mistake and this is not my debt. it is my fathers (we have the same name). so do I go about this the same way as I normally would first disputing with the CRA's? only issue I see is the information on thejudgment is correct as that is my previous address and there is no wrong information. it is filed correctly just the wrong person... |

Yes dispuste that this is a "file mix up".
But you will have to state that this judgment belongs to your father, at such and such address. And you are; " king Jr. ". Send copies of your SS#, Drivers lic, proof that you live in FL, untiltie bills, etc.. Proof that you haven't lived at that address for x number of years. They should be able to verify all this from their own records since you have other accounts reporting.. |

That's good advise but why should OP give evidence to support a case against his father. They screwed up with this judgment on his credit report and all they need to do is remove it then find the right person the judgment belongs to plain and simple. It's not his job to discover who the debt belongs to he just knows it not his...

Because if the OP simply disputes it as "not mine" with no supporting evidence to the contrary, the Cra's are going to assume it's his based on the simple fact that his name is the same as his fathers..
This way if the OP provides ample proof that it's not his such as DL, etc then there should be no way the Cra's can verify it. (theoretically speaking that is).. |

Well here is the issue I am seeing. I have a copy of the judgment and on it it has my full name and my middle initial (K). I am not a Jr. me and my father have different middle initials (his being "L") so will this be an issue that the judgment is actually filed correctly in all regards just the wrong person it should be john L doe where it has John K doe. and I did live at this address for most my life growing up, but I'm wondering if that will be an issue that it seems that the judgment is filed correctly for me but it should have been for my dad...

I would contact the landscaping company and give them a chance to correct this. Let them know this is damaging your credit report, and they have the wrong person, and it should be your father and not you, and you have not lived at home in some time, and the home is not in your name. That they also have the wrong Int in their paperwork..
Given that they filed with the same int as you, I think (but could be wrong) that the Cra's will just verify the information regardless of what information you send them because the name matches.. This post has been edited by. Beli. : 16 January 2010 - 04:06 PM.. |

Given the situation what do you feel is the best process for me to go about disputing this:.
1. try deleting all old addresses (witch I think will be an issue since now I have a judgment corresponding to one of my old addresses). 2. file a dispute with the CRA's trying to correct this. Or do I first contact the landscaping company seeing if I can get anywhere with them?. Or should I start with the court house and find out what options I have?. I just want to know whats the best way in going about this. I don't want to do anything that makes this any harder for me to correct later... |

If it were me, and knowing how the Cra's are, I'd give the landscaping company a chance to correct it. Explain to them that the judgment they filed is on the wrong person, that they filed against you and not your father and they have the wrong Int showing on their paperwork..

First off dispute it with the CRA's.
Then file a furnisher dispute with the landscaping company. Send them proof that you haven't lived in MD for some years, and they have placed this item on your Credit report by mistake.. It may be a file miix up, case of mistaken ID. Ask the landscaping company for a copy of the judgment.. Once you have a court and a case #, call the courthouse and get a copy of. Everything. In your file.. You may have to file a motion to set aside/vacate the judgment if the landscaping CO won't budge... |
