A lot of attorney's do collections as extra income. Everytime I've sent a validation letter I keep getting offers for 50% instead of proper validation..
I think they realize they don't have a good case and want to get something. If they had a good case they wouldn't need to settle for 50% right away.. When I validated with Midland the account got sold to another CA. I then disputed the Midland as not mine with the CRA and it got deleted... |

Am I missing something? You have sent out two validations with no response. You have gotten :.
A. continued collection activity from the attorney when Midland hired them without validating.. B. continued collection activity when you sent a request for validation, and they offered to settle in response to your attempted 2nd validation.. Take a look at Butch's "subsequent CA strategy" letter in the sample letter forum.. |

I'm working it right now. So far, I did get validation, although without credit for a payment made. I sent a 2nd letter to the CA, (not proper validation touch my CR's and be sorry!) and payment proof to the OC at the same time. No final results yet, but at least it's holding RMA at bay on my CR's...

If they choose to seek judgement, I'm sure they would still be amicable to settlement even after they have filed papers. After all, that's the plan that many of us here use:.
1)Dispute. 2)Get FCRA violation. 3)File small claims suit. 4)???. 5)Settle! (for deletions). Kidding aside though, it seems that you just want some type of reassurance since you indicated that the settlement offer of $3000 is still out of your league. Personally, I have received an "attorney" letter that went nowhere. Although it did not include an offer to settle... |

Hmm ok. Well it sounds like I am on the right track with Midland never validating and now these 3rd party collectors not validating but instead continuing with collection activity...

If you've requested validation, they are required by FDCPA to cease collection activities until they have provided you with validation. Until then, court should be the last place they'd want to go!..

Oh yeah I know. Midland already has a few violations and this 3rd party CA they hired is only adding violations as we speak. The balance is about 7,700 so maybe I can get a few more violations so that I have enough to make it not worth it for them to take me to court..
What I am thinking is that this 3rd party CA is only getting a small cut of the total amount that I owe. I doubt it would be worth it for them to even incur one or two violations against me. They already incurred one by continuing collection activity when I asked them for validation... |

Yes, I've used butch's letter twice now (modified) and got positive results..
I'm not familiar with New York state law, but they have violated federal law by sending you a collection letter after you specifically requested validation.. Make sure you saved all your documentation.. Also, they probably violated at least another law, by not putting the item in dispute on your credit report.. And they've probably updated your credit report since you originally validated which is another violation. (continued collection activity again). As long as you have all the validation paperwork and CRRR reciepts, AND it isnt within the SOL for collections in your state. Butch them.... |

You gotta love those boneheads at Midland. They have 2 FDCPA violations with me also. Sounds like they need to read this act...

In my experience, Midland was extremely sloppy and racked up 4 FDCPA violations. They NEVER validate and they almost always keep the dunning letters coming. If you are persistent, these boneheads will delete...

That particular it's doesn't need an apostrophe, it's a possessive rather than a contraction..
Personal pronouns, including it, do not have any apostrophes for their possessives. Using an apostrophe with the possessive 'it' would be like writing her's or our's rather than hers or ours.. OK, grammar lesson over, back to your regularly scheduled program.. ;-).. |

Me thinks, that Midland is having problems validating and Me thinks, that the attorney had better dot his i's and cross his t's or maybe he will get a complaint filed against him with his State Bar Association..
Collection has been frozen by a previous dispute and validation request, right?. Again this is just what, Me Thinks!. Tuit :-).. |
