My question is If I move do I HAVE to get a Lending Tree mortgage? Looking forward for any answer or 2. Another quick question... Hello all,.

I just sent a nut-case letter to a paid collection account which shows on all 3 Cr. I received the green card back on 1/24/03 and no response from this agency at all. What is my next action in regards to this group? Should I just send an intent to sue letter or a subpoena for small claims court to get this removed?..

Hmm... I need to find out myself. I don't know what is the answer. I'll do some investigation and get back to you if I bump into an answer. You should email the people at Lending Tree as they probably could assist you..

In my opinion you need no other reason for a nutcase other than to verify all procedures and guidelines have been followed to the letter...

My basis for my nutcase is that because I was very new to credit report and proper validation of collection accounts, I paid this ca based on the fact that I don't like to have outstanding debts. I asked this group to substantiate their position but I have never received a proper validation for this account. Now this crap is on my credit report for the next 4 years and is messing me up. I want is gone, I would like them to give me my money back but oh well. Also note that I am in California and this company is in California. I never received my 30 day letter or the subsequent letters to even dispute this liability one way or the other.

I am working on my plaintiff statement and I need some input for request for damages...

Epitomee, did you read the FAQ? (If you did, great!) If you remember from the Nutcase related links, the next step is to send the next letter in the Nutcase series there are several. "Intent to Sue" is not the next step. That said, no tactic works all of the time, but I find it useful when I'm stumped about how to proceed at all to follow in the successful footsteps of those who've treaded the path before. Good luck to you!.

Bukethead, respectfully, that's not what the Nutcase Letter is designed for. I wrote it and posted a rationale for it's use. Thanks!.

Well Doc,.

I have sent a nutcase letter to this paid collection and the only thing I have received from them is verified information from all CRA. I have not received any response from them except the green card which substantiates that they have received my request for full substantiation of this liability and subsequent documents to support their position (notarized and certified) on Jan 24, 2003. I am at the point that I feel persecuted for just paying a bill without questioning the validity of the bill. (I am a newbie) This liability was paid in 2000 and is still haunting me and will haunt me until 2006. This was a $113 bill which is in actuality costing me thousands of dollars..

They have my money, but they are continuing to defame my character to potential creditors and present creditors (neg cl increases for existing cc)..

Okay,.

Yhinking of sending nutcase letter for the 3 things I paid but never had validation for. Had to pay them becasue of Lending Tree loan approval. Anyways, they have never proved it to be mine. Frankly, I don't care if they keep the money if they will delete. There is only one that really concerns me (only 200 bux) as the other 2 drop this year anyhow..

Hmmmm....it is a med collection and I bet I can use whychats letter for medical collections. Maybe if I send it to oc stating I never had validation but paid it, not as an admission that this was mine, but as a measure of good faith towards resolution, they will authorize deletion...hmmm.

Whychats letter is GREAT!..

Doc, I understand your intial use for the letter as I have read the posts you make on a daily basis, as I repsect where your coming from and the work and effort you have put into this issue not only for yourself but for others.. I just am stating MY own use for the nutcase letters along with variations of said letter.. I think the whole credit fight has to be one that the person fighting it feels comfortable doing. Some people are great talkers.. and can talk a deletion with a CRA rep.. while others are very litigious..

Like myself.. Use the same tactic they use..I am going to threaten an bother them until they either provide valid proof of said account, or delete it .. But as always , I respect you for the work you have put into it.. and I hope you look at more along the lines as your lettering serving the same purpose just in another way for me at least..

Hey Doc,.

I read the FAQ and re-read. I think that I will do a combo of a nutcase/intent to sue and see if this will get me some re-dress with this CA. I did see that this worked with one other person for a paid collection...

Cool, but did you consider sending the second letter in the series "Son of Nutcase"? betacredit did a great job with that..
