First off, I want to know the interest paid on countrywide second Lending Tree mortgage? Thanks for any comment. Another question on my mind: This new collection agency (I think) popped up on my credit report this month out of nowhere. The debt they list is an Exxon card that was discharged in bankruptcy in 2001 with my completion of a Chapter 13 Plan. Now, all of a sudden they "acquire" the Exxon debt and they are on my credit report, along with Exxon taking up another trade line. My FICO took a 15 point hit immediately. Meanwhile I have not recieved a single letter from them or any attempt to collect this debt - just their successful attempt to sabotage my credit recovery. |

Good question... I dunno what is the answer. I'll do some research in Google and get back to you if I discover an useful answer. You should email the people at Lending Tree as they probably could answer your Lending Tree question..

I would think twice before calling them. They are dirtbags. If I were you, I would probably think about going straight to ITS for violating the BK collection stay...

Did you use an attorney for your BK? Maybe they will help you. You should really do a search on Sherman Acquisitions on here. They are some of the lowest of the low.. Good luck!.. |

I have them on the phone as I write this. Seems they have 3 accounts of mine, all included in the Chapter 13, but only one was reported to CRA's..
The on ein question they admit they bought a year and a half after the discharge (talk about them throwing good mone after bad). My position is that by buying a debt that was legally discharged prior to purchase and then posting it on my Credit File that constitutes an attempt to collect through coercion. Think that will fly?.. |

Once a debt is discharged through BK, it is no longer a debt. And, yes, the FTC has stated that placing a collection account on one's credit report is "collection activity." Pursuing a debt that has been discharged is illegal..
Also, Sherman is part of Gulf State/OSI/Palisades. They are dumber than a bag of hair but will not put up much of a fight if you challenge them. They should remove it quickly. However, many CN'ers have complained of having their tradeline deleted only to see it reappear under one of their affiliated company's names... |

Their story now is two of the accounts (the two NOT on my credit file) were acquired by them about a month before the Discharge and therefore they are the creditor. Does the fact that the Automatic Stay had been in place for 3 years at that point mean anything? MY position is on the 3rd it was acquired by them after the final discharge and therefore I never owed them any money since my legal obligation to pay had been extinguished. I have given them until February 22 (a Sunday) to completely remove that line from my CR or I go to Federal Court on the 23rd with a Motion to Cite for Contempt against the principals of Sherman Acquisition. Maybe one of them would like to spend a month in Club Fed?..

Write one strongly worded letter to them, and they will delete and send you a copy of the UDF. My husband had 3 debts, all included in a CH13, that popped up on his report about a year ago..
They are total dirt bags BUT they are banking on the fact that you will not call their bluff. They will delete... |

I just got them to delete an account, had nothing to do with BK but a debt they "bought" from OSI. Could not provide validation and they made several violations in the process. They fold relatively easy...

These folsk are weasels vewry demanding on the phone butr fun to play with. They make all kinds of stupid threats but just fight the paper war and they will give in..
