My 1st question is: How to pay sears/citi Discover Card on line, is there a site for that? Thanks in advance for any answer. Another question I got... Alright, I'm 22 years old, I work full time, and make about $2,400 / month. My cost of living (only neccesities) are about $1,400 a month. I currently live in Nevada, and that's the state I acquired all of these debts.. |

What do I do? Just send them a letter in a regular envelope, asking for my credit report? How much does it cost (since I got my free one already in the last 12 months)...

Kawasaki good times card? I ask because I ended up in the same situation a few years ago. I wish I had known then what I know now. Anyway, I am wondering if they even had the right to repo the bike if it was placed on an unsecured revolving account. You would have to pull a copy of your card holder agreement to find out. I checked Kawasaki's site but couldn't find any details. It's probably worth a trip to a dealership to get a copy of the cardholder agreement to confirm the details no matter which manufacturer it was.. In addition, there is a good chance that you can argue that this debt is revolving which gives you a 4 year SOL in Nevada and not a 6 year. How long ago did you quit making payments?. You should care about whichever one the person who is about to loan you money plans on pulling. This means either you fix all of them or you fix one, lock the other two and just expect declines from anyone who refuses to pull who you tell them to... |

"The most?" Equifax, Experian and TransUnion. These three stooges at least, but you should also check Innovis. Also, keep in mind that there are many smaller, lesser-known CRA-like organizations out there that some companies (including banks) and government agencies use, but you won't ever be able to dispute.....

OP is being illegally threatened over the phone at ridiculous times of day. I think he should quickly learn about his rights under the FCRA and FDCPA and start documenting violations so that a lawsuit from the CA becomes much less likely (or, if they do sue, he might actually win more from them in a countersuit on the violations...)...

Kind of like that.. Except it wasn't the Kawasaki dealership, it was some local dealership, "Carter PowerSports".. So they had their own "good times" card. But yeah, came concept. the payments were made to "HSBC Card Services", or something weird like that. the only took payment over the phone, or by check by mail.
Wtf?. My second bike (not repod) is on one too. they tried to come repo it like, 10+ times, but it was in my garage, eventually the repo guy gave up. My first bike though.. they took.. so sad.. I loved that thing... I missed two payments early last year, but caught them up within 30 days. Then in July of 09 I missed another payment, and tried to pay it and August's bill in early August. They refused my payment, so I just stopped paying (with Discover card) them entirely. They repod the first bike in Sept, and never got the second one.. Lol.. George, I'm just asking, "What do I send them?". I can write the letter, but what does the letter need to say? "Can I please have my credit report, here's my social, DOB, etc"? I have never gotten my credit report this way, so I have no idea what I'm really asking for, and what they're looking for.... |

Sounds like you need to go through a credit restoration program. A lot and I mean probably 40 to 70 % of negative remarks on your credit report could be deleted and just wiped away because they cant be verified or that it was just not suppose to be on your report. I could possibly help you out with your situation...

After they repo'd my first bike, I started researching online, and quickly found out that much of their practices were illegal. Unfortunatly, I changed my phone number, so they don't call me anymore. Should I make contact with them, and record them and the things they say?. When I did talk to them they threatened lawsuits, police interaction, and insulted me on many occasions. I remember a few of our conversations going something like this,. Me : " I don't have ten thousand dollars I can just send to you right now". Law Office : " Don't you have any family or friends? Call everyone you know and come up with the money by tonight or we're calling the police.". Me : "I don't have any family or friends that can help". Law Office: "Well that's probably because you're a bad person who doesn't pay their bills. I wouldn't want to be your friend either. No wonder your family doesn't talk to you". I was in shock, and completley stopped caring about paying (with Discover card) the bill after that.. Changed my phone number, but now they are calling my girlfriend saying the same crap.. Should I record them on her phone? I have skimmed over the FDPCA, and know quite a few laws they've broken.. 3. Call repeatedly or continuously. The FDCPA considers repeat calls as harassment. [15 USC 1692d] 806(5). They called me 15+ times a day, every day, for about three weeks (until I changed my number). A few of the calls were between 1:00am - 6:00am my time (PST). 4. Use obscene, profane, or abusive language. Using this kind of language is considered harassment. [15 USC 1692d] 806(2). I don't know about "profane" or "abusive", but insulting my family, friends, and me was too much. I tried to tell them what happened, and that I could catch up to current status and pay next months bill, but they just said they want the $10K, and insulted me and the way I ran my business.. 13. Ignore your written request to verify the debt and continue to collect. A collector can't continue to collect on a debt after you've made a written request to verify the debt as long as the request was made within 30 days of the collector's written notice. [15 USC 1692g] 809(. My lawyer friend sent them a letter from his law office, requesting more documentation on the bike, and the sell price at auction. I haven't recieved anything yet, and it's been about two months. They keep sending me letters saying they will sue me if I don't make full payment in 30 days... |

Saying they will sue you if you don't pay in 30 days and then not filing suit is a violation actually. I would probably consider hiring a consumer rights attorney at this point.. Well.. From what I've gathered, I'm pretty much screwed.. What about claiming bankruptcy? Chapter 7 or 13. I mean, I have no assets, no cars, no house, no money in any bank accounts, and since I'm only 22, it should be off my report when I'm 29 right? It's going to take 7 years for this stuff to get off my report anyways right?.
I think it's pretty lame how if I pay off my debts, it's just as bad as them being not paid. What motiviation do I have to fix things, if I spend thousands of dollars, and don't get anything in return? I mean, I could sit here for the next year or two, saving, sending lettes, paying (with Discover card) these debts down, but these creditors don't "have" to do a "pay for deletion" right? They can just say, "No we're not taking this off your report, and you sir are now getting sued" So technically, I could pay them $10 grand, and on my credit report, it will still have a negative standing right?. I think I'm just going to pay off the g/f's credit cards, down to > $100 balances, and then figure out what to do with the two bikes, since they are on her report too. Hopefully her credit won't be too bad. We'd eventually like to own a home, but that won't be possible for 2 - 5 years anyways. We really need to get a better car too, but I think we'll just save cash, and try to buy a used one for now.. I have to admit, I feel pretty ready to throw in the towel.. I made payments, on time, every month, for two years.. Even paid DOUBLE the minimum payment.. I miss one payment, and offer to pay it back, and they destory my life, my future.. I can't get a car, I can't get a house/apartment, I can't apply for better jobs.. What am I supposed to do now, just wait 7 years to pick my life back up? I can't really "dispute" these charges off my report, because there's nothing to dispute really.. I applied for credit, spent the money, slipped up for 60 days, and ruined 7 years of my life?. Ugggghhhh.. I just feel so.. Hopeless.... |

Oh no, you're a long way from hopeless - unless you just don't care. That's no way to think at your age. Or any age, really. Go read the success stories. See what can be done - and it isn't that hard. It looks hard when you haven't really started, but once you start, it's just "do the next thing" and you have a great group of friends who will cheer you on and share what they know...
