Thanks everybody. I am sure you are all correct. It's just that I am getting an absolute run around with these people and I refuse to pay a bill that has a few THOUSAND extra dollars tacked on to it for no apparent reason that they will not delete even if I do pay. I thanks you all for your help and truly appreciate the time each of you took to address this post. I just need a strategy is all and then I am confident I can tackle this. I have conquered 5 stubborn OC's/CA's already and I am sure with a strategy these guys will fall also...

If I read their site correctly, they recieve no funding from the State of Maryland (they are self-sufficient)and they also employ an outside collection agency. Are they really a state agency?.
You now live outside the state of Maryland? I would wager that they have retained the outside collection agency for the purpose of collecting out-of-state debts. If this Maryland state agency is not licensed in your state as a collection agency (assuming your state requires it) you should point this out to them. In all likelihood, they will turn it over to the outside collection agency they have retained. This agency will then be responsible for FDCPA and FCRA violations... |

Okay. I have some solid answers. The State of Maryland Central Collection Unit's third party debt collection.
Contract. Is actually posted on the net. The state agency automatically turns the debt over to the private collection agency after 6 months. If the private agency fails to collect, the collection reverts back to the state agency.. Timing is everything. Stall the state agency until they throw it to the private CA. The private CA is required to follow the FDCPA and FCRA (trustit's in the contract). See if you can get the CA on any violations when they get the account bounced to them. Sue the CA. The private CA is barred from suing the debtor. Hope this helps and good luck on the car!.. |

It has been way past 6 months and I have not been contacted by this private CA. In fact I have not been contacted by CCU either. I have no idea who has the debt at this point. All I know is that it is showing on my credit report under State of Maryland CCU. Would you suggest that I call them to find out if they still have the account or if it has been transferred to this private CA?.. |

How close to the SOL are you on this?. I agree with Boywonder's findings. Stall a bit, see if they throw it to a "regular" CA. She could do this (if the CRAs have violated the FCRA, which I don't think she mentioned), but this will only eliminate the reporting portion of this problem. The root of this specific problem is the CA/OC. Getting a trade-line deleted doesn't protect her from a lawsuit from the OC... |

Be sneakycall the CCU and see if they have the number to the CA. Call the CA and see if they have your account. If the CA has your account, play stupidgive them all your info so that they may send you dunning letters. Ask for validation with the CA. Document any violations. If you can nail the CA with violations you could potentially make enough noise that they just pay the debt rather than risk being sued and losing the fat State of Maryland contract.
Play your cards carefully and you'll come out smelling like a rose... |

From what I ve read so far it doesn't look like there is much danger of a suit. What is the amount of the debt? Catching the CRAs in violation is simpler than getting out of bed. Plus they have no grounds for a countersuit unlike the OC. If it is off the report it may for all practical purposes be gone. At least, that is my line of thinking on this one...

As far as being in danger of a lawsuit, well that is certainly a possibility because the dola is 3/00 which is wrong and they are reporting that I owe in excess of $8,000 which is also wrong by a few thousand dollars. As you can see I am no where near the SOL on this, but I am willing to do what it takes to get this gone. I would settle for it (their listing) being off my reports and sent back to the University so that I can deal with them directly... |

Not meaning to speak for Robin but, I imagine his concern is, if you can't sue unless you first file a claim with the agency you can bet they'll spend whatever grace period the law allows to go into state court in Md. and file their own lawsuit first..
I agree-this is one to handle very carefully... |

I am in a similar situation with Robin...mine is with the university of Phoenix. My student Lending Tree loan guys tried to disburse the funds to UoP 4 times and they refused them due to loosing my admissions paperwork...anyway I am trying to figure what SOL I go by...I lived in Kentucky when I enrolled...the university is in Arizona and I now live in Florida...so Which States SOL applies??? And what type of debt does this fall under written contract or open??.
I understand how frustrated you are Robin, I will be forced to pay this debt in full in less than 30 days if I can not get something to happen soon...mortgage closing!.. |
