My 1st question is: How can I participate in the Discover Card IPO ? Many thanks for any answer. Another question... Ok, here's the issue..

DB got a Dunning back in late 12/2009. He sent a LC&D, and DV request in the first 30 days. (Dont know if they are on his reports, I'm having him check on that).

They have since called 18+ times after getting the letter. And yes it was sent CMRR, he has the Green Card..

He even got some calls today..

The issue is that it's an autodialer, that says call back at 1-800-blah. No options to speak to anyone. The first few calls he hung up on them, only to have them call back in 5 minutes..

So here's the violations I'm looking at:.

1. Harrassment under the FDCPA by causing the phone to ring constantly. (cant remember exact wording).

2. Violation of the FDCPA's Cease Communication.

3. Failure to cease collection efforts after the letter was received..

I'll research the TCPA, may have something in there. not sure..

I guess this is the new scam, leaving a message to the consumer, and then making the argument that the consumer called them. Im not buyin it though..

Any input? Any laws we missed? And no, they have sent NOTHING by US Mail..

He has an excellent papertrail, and hopefully a good case...

I'm stumped. I'm not so sure what is the right answer. I'll do some Googling and get back to you if I got an good answer. You should email the people at Discover Card as they probably can answer it..

It turns out that this IS a business debt. The dunning letter is addressed to his company.

Maybe we can turn to state law then. I gotta research this more and dig up more of your previous threads..
