Question I have... How can I lower my monthly Lending Tree mortgage payment? Looking forward for any comment. Another question I got... I saw the link for the RMA discussions however, all I get is website not responding..

I just received a letter from them demanding payment. I see where they have been on my report since 2001. I have NEVER received any correspondance from them. It even says on their tradeline... Chargeoff can not locate consumer..

So my question...demand for payment no miranda rights...Violation? I am about to send off a validation request...anything else I should do?..

That's a good question. I'm not sure what is the answer to your question. I'll do some research and get back to you if I discover an answer. You should email the people at Lending Tree as they probably could answer your Lending Tree question..

Does the report state whom the original creditor is?.

Is the original on your report too? Are the dates the same?..

There is no date under date opened for RMA.

DOLA for original creditor is 2/99.

DOLA for RMA is 12/99..

Wow...they reaged it 10 months already. Have you ever spoken to them or anything? You can call them and they might be able to tell you something. They were not very helpful with me, but it was kinda fun to mess with them...

I received a letter from them a couple days ago. So, I called in response to it. I asked for validation and the woman started reading what she had in the computer and I said no that is not what I am looking for. I want copies of original contract and all debts incurred. She said I would have to send that in writing..

I have never received anything from them or had a conversation with them. I never received a letter stating I had 30 days to validate..just demand for payment...

Hopefully someone will pipe in with their thoughts...I think what they sent you is a 'no no'. from my understanding it shoulf have the miranda and so forth. I could be wrong though. You would think a big co like rma would know this...

Well mine was at the 7 yr mark. The original creditor had dola at 12/95, but rma had it at 8/96. I had the cra verify both. then the original fell off because of age, so I contacted the cra and questioned as to how they could verify both with different dates as they are clearly the same account and pointed out the obvious reaging from rma. After a few emails and a phone call from the cra it was deleted. Im not sure about yours though...its not quite as old as mine was.

Of course if you attempt to sue rma they may just give up on you. Is it past the sol for your state? Is it a large amount? etc etc? look at all these factors...

Feb 03 would be 4 yrs from DOLA, so a little more time left. It is for about 1000.00 but they have 1600.00 with the interest added in..

I guess I will go forward with the validation request and see if I can get them on a couple violations and go from there...thank you for all the input..

Any other opinions out there??..

I'm dealing with them to! They have a CO on my CR. I disputed it and it was deleted from EXP and EQ however, they left it on TU. Later I disputed it again and it come back as paid. Well... I'm about sick of the whole issue. So, I sent a letter yesterday to the Public Service Commison along with the BBB since this is about a phone bill (that really isn't mine)! We will see how it goes from there..

Good luck to everyone these people are a F88king pain!..

I'm dealing with these clowns myself. They reaged a Sears account by 7 months just to keep it on my EQ CR. I sent them the intent to sue. If it is not off my file within 15 days, I'm heading to the courthouse and I will file suit against them for numerous violations and defamation of character. These clowns need to be put down..

They have re-aged my account as well but it is not anywhere close to time to drop off my report. I guess for now I will send validation and see if I can get them on more violations...

Are you saying that in Feb 2003, this debt reaches the SOL for your state? If so, I would hold off until that point in time, then send them validation. They could turn around and sue you! I wouldn't call them either. Their word means nothing unless it is in writing. The will lie lie lie..

Let's see: You have a letter with no mini miranda, and illegal reaging..

You could wait until the SOL is up, then send them an intent to sue letter, telling them to delete or you're going to sue. This is what I had to do with RMA (except mine was a paid collection)..

They are very slow, but I finally received a letter in the mail from RMA that said they were going to delete all negative info from my credit report..

Whatever you do, keep good documentation records, and do everything in writing...
