I have just started working with my attorney on a FDCPA violation with a CA. I emailed over all the documents and he emails me back stating hey there is no date or tracking number on your green card.. |

You work for the USPS? Let me ask you a question then. Wouldn't something like that be considered tampering with the mail therefore making it a federal offense?..

I think that refers more to opening mail, but I'm not sure what exactly they were trying to accomplish since you're given an article number when you send it off it's a tear off receipt I suspect many people just throw it away, though. Mail clerks ARE supposed to date (internally called round-dating, obviously because the stamp is round) the return receipt card...

If you want more clear evidence go to the USPS counter and ask for a copy of the signature they have on file..
Every time the USPS delivers items with the green "certified receipt" they require that the recipient fill out a pink post-card like form with (1) their name and (2) signature. This is in addition to also signing your green card which you get back in the mail. The USPS keeps a copy of the pink postcard with their files. You can get a copy of this at the counter (tell them you need it) and they look it up / print you a copy... |

Yes, there's the original form, and we have to scan the pink slip so there's a digital copy of it (that's the real signature that goes in the system). That is available on request whether you have return receipt or not...

I know that we routinely get mail that has a white sticker on it bearing a bar code...not anything I would consider overly adhesive though. The sticker is about the size of a small file label. They appear most frequently on the green cards and on the large flat envelopes, presumably to make it easier for the bar coding to be read by the sorting machines..
However, these labels all peel off VERY easily...they tend to be only marginally more sticky than a non-3M Post-It note... |

No problem I deliver to the post office I was told it is done sometimes by the machine to put on a bar card stupid if you ask me I kept everything so I am good but it pisses me of they could just as easily put it on the over side that doesn't cover anything up just my 2 cents.
Oh yes as far as peeling off it came off once I bent the card a little .. Never mind, although I still think the postal worker should ensure that the person signing dates it at 5 bucks a pop I should get every pennies worth!!.. |

Machines are only as smart as the programming...and my guess is that the one that puts the sticker on isn't smart enough to flip the card..
Good. If I have something where I want to make sure it gets done, I use a highlighter on those fields...the rate of fill is surprisingly higher when I do that than if I don't highlight the three fields..... |

I've had a couple of green cards come back signed, but undated. Sometimes they carry the round stamp, sometimes not. I think they always had a dated postmark on the reverse side ( the side carrying my address) so at the very least, the recipient signed it at some point between the date I mailed it and the date the postal service mailed it back. Good to know about the pink slip for more precision. Thanks!..

Sometimes the machine bar codes it back to the recipient and that has to be corrected (I use a permanent marker to black out the errant bar code). And corrective bar code stickers (also used for magazines and manila sized mailings) are purposely not sticky enough to destroy anything. The article number on the return receipt is on the bottom of the card, so the bar code could be printed/stuck over it (though they stick them everywhere, sometimes it's annoying because it's stuck over a delivery confirmation barcode we have to scan).
