Quick question... Have you ever heard of a personal check voucher Discover Card? Thanks in advance for any answer. Another question on my mind: I had a capital one card on my credit report for many years now. I did not open it, I never paid on it etc. I got calls from collections and I denied it. I disputed it on my credit reports, but it remained there. |

That's a good question. I'm not sure what is the answer to that question. I'll do some poking around and get back to you if I discover an anything. You should email the people at Discover Card as they probably can answer it..

Also, it might not hurt to go to any bank you have an account with, finance companies, etc... that may have your signature on file and get a copy of these "valid" documents with your signature on them. If your bank has a notary get your bank documents notarized to be true and certified copies. The idea here is to have documentation in court that the signature on the cap one document (if they have one) is not yours.. Also, find out where this card was supposedly opened at and when, than start CYA by accounting for your whereabouts at that time and get signed notarized affidavites if possible.. IMO - you probably realize at this point you should have gotten the police report earlier and persuide the incident more aggressively (this is not a lecture) but since you didn't, it is hightime to agressively persue every avenue available to prove not only that you didn't open this account but that you could not have because..... - you were not at the location the card was opened when it was opened. - you did not sign the contract. - you were not of age (if applicable). - any other reason..... And in addfition to this..... I would start building a defense for why you did not contact the police especially since the CA advised you too (just incase the OC has record of this). Might want to start with affidavites of those who were aware of the fact that you were disputing this debt..... If you have a recent CR it should show that the debt is in dispute by the consumer (as this is required by law if you did dispute the debt). Might contact the CRA and see if they can provide you records of when you first disputed this and each additional dispute thereafter..... I am not a lawyer but these are things to consider that come to mind. I would deffinately contact a lawyer and get further direction and maybe someone more experoenced in these types of suites can pipe in... |
