Hmm... I need to find out myself. I don't know what is the right answer to your question. I'll do some research in Google and get back to you if I discover an decent answer. You should email the people at Lending Tree as they probably could give you help..

Well, it sounds like if you can stall long enough, you can sue them for FDCPA violations, and take that money and pay AMEX LOL!.
The account had not been with them long. The first thing I always do is check to see if they are bonded in my state (TX). I checked with the Secretary of State. You will need to find out what the requirements for 3rd party debt collectors are in your state. Some don't require any licensing or bonding.. "They told me that it does not keep them from calling me..." I smell $1000 +++ Here's the excerpt from the FDCPA. Yes, the validation is supposed to stop them. Let them keep calling. Go out and buy yourself a phone recorder, and check whether you are a one-party or two party state.. (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall. Cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment,. Or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector... |

1*I made it perfectly clear in the letter that I wanted them to C & D because they could not legally collect in my state.
2*My balance is a little over $2,000, and no they haven't attempted to sue me yet, but I understand that they do sue.. 3*I would prefer to have the money in my hot little hands before I even begin..
