First question I got is Does visa or Discover Card cover thefts made on things you purchased with it? Many thanks for any comment. My other question... I got a letter from asset saying I have 15 days before they seek wage garnishment on a default judgement..

Amount is around $6000..

If asset holds any paper on me, it's gotta be 10 years old. (I'm in Ohio).

Any idea what my next step should be?..

Yes sir! although you might want to make sure and wait for someone else to confirm this as I am not completely sure. Better yet, why don't you ask the Discover Card guys because they can give you an answer better...

They are legit and they will put a judgement on and garnish. if you want to avoid that I would make an attempt to work out some kind of agreement. I don't know about oh but in ny they first give you a voluntary judgement with a due date and a set amount. if you miss that the wage garnish goes into action...

You're jumping a bit ahead. Before they can obtain a judgment they first need to file a suit against OP and serve him. OP has a decent chance of successfully defending any lawsuit filed by a JDB if the advice in the HIBS forum is followed...

I assume they have a judgement by what they have state in the letter...

Also, If I settle - how do I do this without getting worked over?.

I have no idea what the original debt was for, how much it originally was, how many fees, penalties and interest has inflated the number. They sent me a "Settle for $2000" note a few months ago....

At this point is it too late to ask for more info?..

While waiting for other responses, use the search function. Probably a good place to start.

Would be voiding judgements or the like. It sounds like you were never served/properly served.

With the complaint that they presumably had filed, where they may have won a default judgement on you..

I dont recall exactly what I've read on judgements, other than there is a process to go through that will.

Either void the judgement and it goes back to court.....or, at a minimum will help you get the garnishments.

Placed on hold so the legal mess can get sorted out..

Good luck..

Asset sued me and won and they did this all in the midst of me filing BK. Of course it was all vacated but they certainly tried to pull a fast one...

First off You need to find out IF there is an judgment. If they do not have one then they cannot attach your wages. Go to your local court house and see if there is one. If you have NEVER been served, then you can still fight the wage garnishment..

I do not know if a judgment can be renewed in your state, But you need to find out...
