First question I got is Does Discover Card have travelers cheque? Thanks for any response. Second question.. Some jackass CA sent a letter to me today trying to collect on a Compass Bank Discover card that was charged off after my father passed away. This is his Discover card and I know that because I've never done any business with Compass in any way. I guess my mother never paid it off after he passed. |

Of course! but you might want to make sure and wait for another commenter to confirm it as I am unsure. Better yet, why don't you call the Discover Card guys because they can answer you better...

When one dies and there is no "ESTATE" they can't collect from the "ESTATE".

The amount is $4500.
I won't berate my mother for not paying (with Discover card) off a Discover card after losing her soul mate. She was devastated during that time period and I doubt her mind was on paying (with Discover card) off his credit card. I'm not saying she shouldn't have been looking out for her own security but I can't fault her for it... |

I thought only so much time could pass before you couldn't file against an estate. My father died almost 5 years ago...

While sending them a FOAD letter will take care of the problem for you........
I would;. Review Texas (? does your mom reside in texas? ) probate code. Ask the estate attorney if you had one, whether this debt was included. And ask Mom whether she was an AU,. And made any charges on the account before or after your fathers death. How long ago did your father pass away?.. |

FOAD & cease and desist, and they better not have this on your reports.. & tell them if they need to verify the fathers death,. They can look it up in public records themselves you are under no obligation to supply this to them... |

These are good questions to ask. My mother actually lives here in FL. My folks retired out here and I had just moved out here to attend grad school so I wasn't too far away to help her out..
I posed your questions to her and she said the card wasn't included in the estate but it was NEVER used after his passing. I'm going to draft a FOAD letter to these idiots and use all the key points ya'll made. As I said before, after my father's passing, some of his TLs found their way onto my report and it was a hassle getting them off. As far as probate law goes, I think my mother is in the clear on that one... |
