I really need some advice from all you pros. My wife.

Just got a collection on her Credit Report from Portfolio Recovery Associates. It is showing that she owes $220.00 from SouthWest Bell when she went to University Of Kansas. The account is over 5 years old. She has no recollection of owing any money..

We have never recieved any letter from them stating she owes them money. The account was bought by Portfolio back in November of 2002. On December 1st I sent out a Validation letter to them. I have called them and they said they are stilling waiting for the info from Southwest Bell..

We are trying to get a Home Equity Line of Credit, but we need this off. I told them I will pay it if they will delete it, they said no way. I then said " I will have no choice but to sue you" They said " I don't think you will sue for $200..

The reality is, I will sue them so it is now on her credit, since they have not proved it..

I also disputed it with the 3 CRA's. They all came back verified. How can they verify it, if they are still waiting for paperwok? Experian is the only one that has Consumenr dispute listed..

What kind of violations can I have them on. I really need to get this off. I don't know how they would have her new address since she lwent to school in Kansas 5 years ago. When I sent out the validation I put her new adddress on them..

All of you help is much appreicated..

Ye, however you might want to make sure and wait for someone else to confirm this as I am unsure. Better yet, why don't you call the Lending Tree guys because they can give you an answer better...

You should wait for the results of the validation letter and and exhaust that avenue first..

I would recommend the lawsuit as the last resort. If they don't reply to your first request for validation, You may want to follow up with a 15 day letter sen CMRRR. If you still don't get anything after the 15 day letter, I would file complaints with the BBB, FTC, AG, and the State agency that licenses CA's. Also, check and make sure they are licensed in your state. I hope this helps..

I tried checking on the web site for the state of Illinois and I can't find Portfolio Recovery. It is possibile that they are not licensed in my state. They probally think my wife still lives in Kansas when she was at school. She has not lived in Kansas for the last 3 years. What do I do if this true???.

Send them the 15 day estoppel letter. If they don't validate send an intent to sue letter..

HAVE they noted it in dispute with the cra- if not you already have on one violation..
