Got a question... Discover Card suggests: "There are some things Money can't buy"...What are those THINGS? Looking forward for any answer. My other question... Other than on your credit reports TU,EX,EQ where else can organizations find a bankruptcy? I know it's public record but if you don't tell anyone you have a BK and it doesn't show up on your credit reports, how else would they ever know that you filled for BK?.. |

Not everyone has Pacer, specially those outside the legal field, or those not interested in legal cases (Such as FCRA) etc..
But yes, pacer is another example specially used by Cra's... |

You may be subject to an obligation to disclose. Even if it's off your CRs, a thorough background check will fish it out. Depending on what you're applying for, there are adverse consequences for failure to disclose. This is not legal advice..

Many positions and licenses have similar language. It is the FAILURE to disclose that costs people most significantly. The further removed one is from the date of filing, the less harm to the application tends to exist as long as one is upfront about any required disclosures...

I hope so, coming on to 4 years and my credit is clean other than the BK. Going for the 6 and 63 so that right there shouldn't make them too worried. If it was the 7 then I could see why the "might" get concerned. but I hope it goes through, I can't afford not to get the license...

Hkbushido- In a similar circumstance , I affirmatively disclosed. After passing, it was held up two weeks for consideration then got rubber stamped, and I haven't really thought about it since. Good luck!..

I was wondering how old was your BK? What exams did you take? So they did grant you the license with out asking for anything else?. I'm just a nervous wreck right now, trying to focus on studying but this is constantly on the back of my mind bothering me... |

Did your sponsoring firm give you the green light? If you are unsure ask someone in the compliance office..
FINRA does not really penalize for BK as long as there are no other. Current. Issues with credit. You are required by law to disclose and if it's less than 5 years old (I think it's 5) then may have to note that on your broker-check file. As long as you disclose then you should be ok. What FINRA looks for in a background check is that there are no outstanding issues such as unpaid COs and judgments.. If you are unable to be licensed then you will get the notice of adverse action letter from the consumer report pulled and you can appeal it. I have only seen disciplinary action initiated on those who lied on their U4s or failed to update it accordingly pending the filing of a BK petition.. This post has been edited by. Probably 10+ specialty reports out there (Lexis Nexis, Banko, etc) that report public records. LN is probably the most commonly used. Most background checks include a public records search...
