I'd like to roll up my sleeves this week and go after LVNV and get rid of them once and for all. Here's what I was thinking...should I sent them a timeline of my correspondence with them to articulate just how inept they've been in not being able to satisfactorily provide proper validation? I have been keeping careful records of all the letters the firms they've assigned my debt to, green cards and all; it's been over two years and I've accumulated a mountain of data. I was thinking something along the lines of (please note the italics are my notes and I do not plan on including in the letter):.

Dear LVNV,.

I am writing regarding account #1234567890123456 that appears on my credit report as a Factory Company Account. This is NOT true. You are NOT a factoring account. You have also have been reporting this as an Open account. This is also NOT true. I NEVER opened an account with you.

I have enclosed a time line of my dealings with these firms. Please note that I have kept careful records of my correspondence and sent each letter via Certified Mail and Return Receipt Requested..

October 2007 €“ Wolpoff & Abramson send letter attempting to collect. DV sent.

October 2007 €“ W&A receives DV..

I never heard from them again..

August 2008 €“ Northland Group sends letter attempting to collect. DV sent.

September 2008 €“ Northland receives DV..

September 2008 €“ Northland sends 2nd letter attempting to collect. DV sent, informing them that they are violating the FDCPA by attempting to collect a debt they have not validated despite my request to do so..

September 2008 €“ Northland receives 2nd DV..

October 2008 €“ Northland sends 3rd letter stating that the account has been closed and returned to LVNV..

It gets weird here:.

October 2008 (the day Northland received my 2nd DV) €“ Resurgent (ahem) sends letter stating they have received my inquiry regarding my account, are investigating, and will let me know the results. They never did. I know Resurgent and LVNV are the same but are they in bed with Northland?.

December 2008 €“ Brachfeld & Associates send letter attempting to collect. DV sent..

January 2009 €“ Brachfeld receives DV.

January 2009 €“ Brachfeld sends 2nd letter attempting to collect. 2nd DV sent, informing them that they are violating the FDCPA by attempting to collect a debt they have not validated despite my request to do so..

February 2009 €“ Brachfeld receives 2nd DV..

I never heard from them again.

March 2009 €“ Sharinn & Lipshie send letter attempting to collect. DV sent..

April 2009 €“ Sharinn & Lipshie receive DV..

I never heard from them again.

Four (4) firms have failed to properly validate this debt and two (2) of these firms violated the FDCPA in an attempt to collect this debt. Since none of the firms you've assigned this account to have been able to validate this debt, this leads me to believe that LVNV has absolutely no recourse in collecting this debt. I insist that you remove this account from my credit reports and cease all collection efforts. I also insist that you agree NOT to sell this debt to anyone else. I will also be sending a copy of this letter to the BBB and FTC..

Good question... I dunno what is the right answer to your question. I'll do some Googling and get back to you if I discover an answer. You should email the people at Discover Card as they probably can answer it..
