My question is Can you buy stuff online with a Discover Card prepaid gift card? Thanks in advance for any answer or 2. My other question... How long can a creditor keep pulling my credit report?. |

The answer is Yes, although you might wanna make sure and wait for another member here to confirm it as I am unsure of myself. Better yet, why don't you e-mail the Discover Card guys because they can help better...

I've always been a little murky on the Permissible Pull topic, so could someone please clarify an issue for me?.
If a debt is beyond the SOL for collection, can you send a letter requesting that the CA cease and desist any and all collection activity? And would that letter not cancel out their PP?.. |

Not unless you were in one of the two States where the debt is expressly extinguished by law when the expiry of the limitations period has been reached...otherwise the matter remains subject to collection..
If there were a poisoning situation, then you would litigate on grounds other than PP.. As to OP, it appears there are many other issues that probably need further explanation...not the least of which is HOW the car came to be 'junked' with a note still in place.. Seriously, mods and admins, I've been around for a while so I know people weren't always so quick like this to jump down people's throats and throw out snarky comments. Responses like this just make people hesitate to join in the conversation for fear of being beaten down or belittled. I really wish it would stop.. And not that you deserve an explanation with your rude behavior tmsamp, but I feel that my question was perfectly in line with the OP's original post and that the answer to my question could possibly help the OP as well as myself... |

I don't know what the problem is with the rude post, but he's been a member since '05, so he knows. Maybe we can chalk this one up to someone having a bad day. Hit the report button is there is a continuing problem..

Anyway, OP, I didn't think an auto financing company had permissible pull to pull your reports once your loan was established. They can't change the terms of the loan so I didn't think there was a business or pp...... I could be off base here....Someone who has been here a looooong time has posted that before in a few of my threads and some other ones I have read.. I'll look for that in a bit... |

Case in point, this is the question from the OP's post that I was focused on.... The majority of replies are that the pulls can go on forever. I thought there might be a chance that once a debt went of out SOL for collection that a C&D letter might stop the dreaded pulling. I wasn't sure, so I asked.. |

Both situations in this thread are different from the person with a current loan...collection activity gives the permissible purpose...

Ok. So if they were CURRENT, then they could not pull.... but if they are late (like OP).... as in how late? kwim? Can they pull if someone is 30 days late? 10 days late? Or is it once they hit "repo" status?.
OP, did you not send the lender any letters or proof from your insurance company or a police report or something that the car was junked?.. |

I'm not entirely sold on the 'cannot pull if current' argument that some have raised. But that would be a discussion for a different thread. This one was already in the process of getting derailed....
I'd still like to know how OP junked a car with a note still in place...presumably the lien would have been on the title (which would have been required in most areas as a condition of junking the vehicle)... |

If the car got totaled insurance would pay the loan first, if that wasn't enough to complete payoff, the remainder would be immediately due as a lump sum. Though it sounds like in this case the car broke down and the owner sold it for scrap without clearing the lien first, which is a no-no..
One day late is a default, and could be considered a collections situation. The creditor could then pull reports to evaluate the debtor's potential financial situation and decide how to proceed.. This post has been edited by. Mk_378. : 14 January 2010 - 10:32 AM.. |
