My first question is Can I use my debit Discover Card in Japan? Thanks in advance for any comment. Another question... Folks,.

I really need some help with this issue:.

I had an auto loan with North Fork bank with an auto debit from my bank account. Eventually North Fork got bought out by Capital One and they assumed the loan, and they continued to auto debit my bank account till the last month's payment was due. I was told that they don't debit the last month's payment automatically, and that I have to initiate the payment separately! There was a bit of delay in this process (about 15 days to a month), and I logged into the Capital One website and made the required payment. I then left the country for a month long vacation - I was expecting to receive my title in the mail from Capital One, but I didn't find that in the mail, so I called back and found out that I still owed them ~$11 and they had sent me a note by postal mail indicating that they will report me to the credit agencies for non-payment. I was bewildered as to how I owed them another ~$11 when their website had indicated that I had paid in full, upon which their customer service told me that this was accrued interest that their website was not up to date with! I paid up this amount and received my title in the mail shortly after that, BUT, when I checked my Equifax report, there was a negative entry due to Capital One..

This account is being reported under the "Negative Information" tab as closed, but it says that I make late payments (61 - 90 days late). The history of payments clearly shows that all my payments are on time expect for the last ~$11 payment!!! Capital One reported this to Equifax in May 2009..

I tried applying for a new Discover card yesterday, and it got denied due to this negative information on my record. I don't know how to get this rectified. I would really appreciate any help with this..

The answer is Yes, but... you might want to make sure and wait for someone else here to confirm this as I am not completely sure. Better yet, why don't you give a call to the Discover Card guys because they can help better...

Try finding an executive for Capital one, (google will be your new friend) and send a GW letter see if you can get it removed..

You could also just try disputing it with the Cra's first as "Never late" if it's on EQ it'll be on the others, so I'd suggest getting hard copies of your credit report from all three...

Try the "never late" first. That got rid of a hiccup that Cap one had on my report..

If that doesn't work or you are in a hurry try a goodwill letter, I saw one here just a few days ago...maybe a $5 starbucks card trick also...

As per your suggestions, I have gone ahead and disputed the entry with the "never late" option. I have also provided an explanation of what really happened. I am keeping my fingers crossed hoping for the best....

So I faxed a letter to the Capital One Credit dispute team and also initiated a credit dispute with Equifax. I heard back from both of them around Jan 1st: Capital One sent a letter to me saying that they reviewed the case and found everything to be accurate..

Equifax resolution says that the details are accurate, BUT here is the kicker, my report now shows as late payment as of Nov & Dec 2009 instead of Apr & May 2009!!! Looks like Capital One screwed me further by reporting late payment as of last month!.

I would really appreciate some help here. Should I send a good will letter to Cap One? Is there a specific address/person that I should contact? TIA..

I would dispute with the CRAs again...this time specifically that you were never late dec or nov 2009, etc....

After it's verified by CapOne, I'd write to them...their executive offices, and outline the details...especially the fact that they changed the dates to 6 months AFTER the loan was paid off completely, in apparent retaliation for you trying to correct their FIRST errors...and that you disputed with the CRAs, and CapOne subsequently verified that it was accurate...and that you now demand that ALL lates be deleted..

Thanks much for the suggestions. I called CapOne and spoke to an agent who asked me to go ahead and dispute it if the record was showing up as late payment in Nov & Dec 09. She said that I would have to fax in another form to the Credit Dispute team to reconsider deleting the entry..

Pryan67, could you please help me with the details of the executive offices? I don't have a name or address to contact. It's amazing that this company is putting me through such a lot of trouble for their own fault and over a $3 payment!!!..

This is weird! I just logged into my Equifax account and got a new report (01/14/10) and the delinquency entry by CapOne is gone!!! I have not checked TU or EX yet, but this sounds too good to be true. Can anybody shed some light into this? Is this a mistake that might be corrected at a later time, or is this permanent?.

I checked the status of the 2nd dispute that I had filed over the phone, and it is listed as "Pending". I am quite confused as to what is going on here.....

I just checked my EX & TU reports - they still list the CapOne delinquency. Could the EQ removal be due to the 2nd dispute I filed with EQ? I had also faxed a letter on 01/12 to CapOne credit dispute team regarding the EQ error.....

All you have to do is google Richard M Fairbank and get his corporate telephone number. It is on google I have found it before. Your call will be answered by a secretary and you need to explain to her your frustration with what is happening and you will be transferred to a compliance manager. Be firm and explain that this late is bogus because..............and you demand that they delete this late from your credit files immediately and furnish to you by the end of the day a doc that states the lates will be removed and you will get it..
