Quick question... Can I resell a Prepaid Discover Card or Visa Credit cards? Looking forward for any answer or 2. My other question... Place of employment and other tidbits. They also mentioned how they knew I'd filed BK a few years ago but then mentioned my maiden name (idiot, I did it while married...) anyway....???? WTH?.

These people are right down the street from DH's work. These are also idiots that I have had to deal with regarding a HUGE issue that I have posted about on here more than once. (SSN on envelope, apartment case....).

They are trying to collect on a VERY low amount of alleged debt. He asked where I was employed. I asked him why he needed that info and if he was going to sue or call me there and harass me. (I don't work outside our home).

TBH, I am a bit concerned that this dumb arse is going to show up at DH's work and harass him, the collector asked if DH was still working at XXXX. I, of course, refused to answer any of those questions..

This alleged debt is from 2007. I have NEVER rec'd letters regarding it and told him numerous times. I asked him why I would receive letters re the BIG debt with no probs, but never got one regarding this little thing. I asked for validation and he said You have it. It's from 2007 and it's for xxxxxxx.

So I sang "EFFFFFFF YOUUUUUUUU" in a loud opera sounding voice and he was offended and told me what I was doing was illegal. So I sang it some more. He informed me I was being recorded. I told him good, then he'd have something to listen to later.

Seriously though, I am really annoyed. I feel like he's threatening me with the fact that he "knows" I filed BK and the questions about employment? Why did he need to know that? Am I the only one who thinks that's to imply a lawsuit or calls at work? I feel a bit harassed...

You betcha! however you might want to make sure and wait for another person here to confirm this as I am not confident. Better yet, why don't you contact the Discover Card guys because they can answer you better...

I am guessing it really is illegal to curse at them on the phone? I guess I never really thought about this - but does this open up the OP to a legal suite? Not to get off topic, just curious if the OP should be concerned about this or refrain from making the same move next time...

I'd like to know what law says that I can't curse at a collector or someone for that matter. I wasn't threatening him. I seriously don't carefor real. For him to be "offended" that I used "vulgarity" (as he said) is hysterical to me. I mean, he tried telling me who was boss by saying stuff like, "Well, the FDCPA laws say I can't send you a letter, we've sent numerous letters that you've ignored." or some other BS. Ya, he knows the FDCPA laws alright.

I'd like to see them sue me. The gloves would come off..

ETA: He should have hung up once I told him I had a lawyer. Instead, he continued to talk to me on the phone.

I believe you would be safe. As you said, there is no law against cursing out.

The only way it would be considered illegal (I would think) is if the Ca collector filed some sort of harassment papers, which I highly doubt...

I think it's buried somewhere in the Telecommunications Decency Act of 1996..

I would pay good money to be in court to hear the arguments for a suit they brought under this title. That'd be good entertainment right there..

The phone is a powerful tool. On which the agrieved controls. If he was in any manner offerded by her actions (although it really does not play well in a transcript of the call read into the court record...you always want the judge to see you as the victem, not the aggressor) it was his right and obligation to immediately terminate the call...

While I'm not a lawyer, I would think the "victim" having the simple option of hanging.

Up the phone would mitigate most/all damages, but thats a guess, based on common.

Sense, which the law rarely seems to take into account....

I really hope we aren't turning the collector into a victim here because I chose to sing to him to eff off. I'm sure I am not the only one who has ever told him that and I am sure people have done it in MUCH worse manners than myself.

They called me. I didn't call them. He could have hung up. In fact, he should have hung up in the middle of the conversation once I told him who my atty was. Again, I'm not worried about being sued for anything, whether it's the alleged debt or whether it's for using vulgarity. I mean, I can understand if my singing offended himI don't know how to sing.

My main concern was the fact that we dealt with these jerks on a MUCH BIGGER issue (like 100x this amt) and their illegal tactics and a lawsuit etc etc and that they KNOW where DH works (down the street) and that some arse would show up there. I am pretty sure DH would NOT be a happy camper....

I'm still checking my reports though to see if they are pulling....they tend to do that, which seems ridiculous to me since they have PREVIOUS knowledge of my credit report as they pulled not too long ago for the lawsuit.....

Couldn't get my recorder to work and the name on the Caller ID was NOT their name. It was some transportation company's name.....

Letter: detailing the convo/their violations? or just say I'm unaware of this debt and am asking for validation, have not rec'd ANY letters regarding this...etc etc...

That's why you hang up on them.

But if you could prove they called and spoofed their info...you'd be collecting from them....

As for the type of letter, I would make it a HEAVILY modified unknown debt letter...letting them know that you've asked them numerous times on the phone to please send their claims via US Mail, but you have never received any communication from them at all other than the harassing phone calls, despite it being required that they DO send you notification, etc..
