What seems to go un-noticed is that once your suit IS filed they usually now want to settle the matter "amicably"..

Filing a suit does not mean you'll have to go to court...

Good question... I dunno what is the answer. I'll do some investigation and get back to you if I find an decent answer. You should email the people at Lending Tree as they probably could assist you..

The thing is, if they had proper validation they would have sent it to you already. that's what the validation series does. Proves whether they can back up their claims. If they had it, they probably would have tried to sue you already or at least sent it..

Either way, your FDCPA and FCRA lawsuit is based on the laws alone, not whether you actually owe it or not...

You know Im gonna try one more time to dispute the entry CHOD, since there are some other things I need to get off Experian. But I am going to start preparing paperwork as back up..

Mecro: I'm no guru but you've gotten some good advice here. Hubby has a no status account. I went through a round of disputes, redisputes, etc. That's when it went to No Status and his score improved. My own personal decision was to focus on something else (we only had 2 things) and then when that was taken care of, go back to this one (same story, by the way, no validation, etc.). So, it's been about 6 months and I've taken care of the other one.



But, I have to admit I'm not looking at a $7000 balance and I understand that concern you have. So, there you have it....that's what I'ma gonna do....

BUT!!! Have you also addressed the AG's in your state? Because that's how I get rid of most of them when they are stubborn ones......

Yeah I did all the complaints against Midland, their San Diego office. But Midland is quite known for it's ridiculous practices and from what I heard, they just grew way too fast and are just cluttered with too many accounts..

Midland has never called me, only sent one letter a year ago and all the other contacts were myself calling them before I learned about my rights. I honestly would not be surprised if I never heard from them again. They were never rude to me, in fact pretty nice and never broke any laws except the validation and dispute status..

I honestly believe that Experian is the real scumbag here because that is the only report Midland still remains on. There is something shady going on there..

But I finally got all the info I really need. Thanks a bunch everyone..

Im in NYC.

I filed complaints with BBB and FTC, just so that something gets sent to Midland. But I doubt Midland can even find my account with only my name..

I threw in a complaint with California Attorney General, but with the # of complaints that Midland gets, I doubt it would actually do anything. Just procedure..
