Were the dispute results to your liking? Here's the problem, if you sued them, the court is going to find that they have proper procedures in place and that a day or 2 late is not a major deal. It won't go very far. If you don't like the dispute results, you might get away with sending a demand letter outlining what violations they committed and demanding that they delete all the disputed accts as it is obvious they were verified after the 30 day legal period. If they were verified prior to the 30 day period, they would have closed the investigation and notified you already...

I don't know, I haven't gotten the dispute results yet, I called and they said that I had one account pending. the problem is I disputed quite a few (i mean ALL my derogs. my judgments got sent back as frivolous because I had disputed them before and the supposedly verified. but if that is true, then I would have a clean report). lol, I already got some of the dispute results back (one oc sent a verification letter to me, and I got the letter back from tu saying that the judgments were frivolous because they had been previously verified, but that's a whole other thing..

Tell me this, don't you have to call the court that the judgment is in to request verification? and if so, why did they send me a frivolous letter stating that a company in lousiana verified my judgment that was in tennessee? is that not strange?..

Usually when court records are verified, the cra's have a human go to the court and look it up. Why does it have verified by someone else? I have no idea, but I would sure find out..

I can tell you that most of the time they don't even attempt to verify. I had a chapter 13 bk that I had dismissed. I disputed it and they claimed to have verified it. I sent a procedural request and was sent the name of U.S. District Court, with the wrong address and phone #. They swore that was where it was verified.

Once they checked that out, the bk was deleted...

So theoretically I should just call them remind them that they took additional time to reinvestigate when the fcra gives them a certain alloted time and tell them that they verified a tn dispute with a la company and tell them that since they never resolved the dispute that began on 11/14, then this item should be immediately deleted or I will speak with my atty general..... okay. this sounds good, but I can see a csr going ma'am I am sorry but we got the dispute on the 29th and we don't do weekends......even though if they didn't do weekends then 30 days would be 6 weeks... I could point that out... and I guess they couldn't do anything but delete the judgment since it was their foul-up..... thanks LKH you are da bomb..

How long did it take for them to check out the correct address of your district court? I will call them friday and inform them that my court and judgment were in tn and why were they going to la to find out about it... is this the right thing to do? or should I send a letter? or is the letter that they already sent me good enough?..

Damn... I wish I had scores in the 600s. I am jealous...;) anyway, no prob about the questions. LKH knows this sh!t. I think that if the company can't verify then you need to get them to send you a letter stating that they have no records older than two years and then forward this to tu. and if you sent validation last month and they haven't responded, forward that information too.

Or something to that extent. and if they verify without sending you back the contract or other instrument, then I would sue their a$$es...

I would wait til you get your results of the other disputes before doing anything. As for the co. in another state, I think maybe you should send the cra a procedural request..

Also, if you are going to threaten violations for deletions, you should do it in a letter, not by phone...

I agree that you should get a letter from the co. stating that they have no record of you being late. If they send it to you, then fax it to the cra. If they refuse, you may need to get a little nasty. Advise them that the FCRA states only accurate info can be reported and if they cannot prove it or verify it, they must immediately delete it...
