Got a question... Anyone have an Aspen Discover Card that was not a scam? Thanks for any answer or 2. Second question.. EQ got my dispute on Dec 16th it has been 35 days and nothing, never marked in dispute..

I did get a result letter dated Dec 22nd for an account that has similar numbers in it but not the account I disputed..

I cannot stress enough how urgent it is that this account gets deleted...

That's a good question. I'm not sure what is the answer to that question. I'll do some research and get back to you if I got an decent answer. You should email the people at Discover Card as they probably could give you help..

Did you dispute using the free report from annualcreditreport.com? If so then they have 45 days to investigate. I think any disputes done online fall under the 45 day rule also although I would have to check that..

EDIT:.

I was wrong...online disputes are 30. I was correct that if you dispute based on your free annual credit report they have up to 45 days..

Jtoast where is the timeline specified in FCRA as 45 days? The only reference I could find was 30 days, it doesn't say anything about online vs paper disputes...

Are we talking about Equifax or CSC? I can't remember which one you are in. Remember CSC goes by first in/first out which I don't agree with but I'm not going to argue the point with them..

I'd call them and see what's up it could be that they verified the account, or looked into the wrong one (The one on the 22nd you mentioned that you didn't dispute)..

Some states it is written such as in Louisiana the CRA has 45 days to complete a investigation..

I can't remember exactly which statute it is..

I don't have my copy of the FCRA with me but I remember reading something about 45 days as well in there..

This is not my first rodeo, I have been here long enough to know to use ORIGINAL reports, I know how to send them a OOPS your time is up on your investigation time limits accordig to the FCRA, I am not after that today..

I am after something that will give them no other choice but to delete it!..

I bet you 20 bucks that is what happened, I didn't make the mistake EQ did, I plainly gave them the account number to dispute and thy took it upon themselves to investigate a different account, I guess the person that got my letter CAN'T READ ENGLISH!!!!!!!..

FCRA was updated in 2003..

Relevant quote below:.

I remember now why I said "online." It was because I noticed that many people who disputed online said they did so by sneaking in the back door...since thats free, thats 45 days. If you want to hold them to 30 days, spend the $10..

Not really helpful but.

I've never actually received any mail from EX besides....we want proof you are who you say you are.

Since OCTOBER of 09'.

I'd pitch a huge fit if they werent actually removing some stuff here and there just never updating me.....I just give it 30 days and send in the next round of spleen.

EQ rather then remove two lates from 03' decided to move them to 09' and call it verified.

When I called the creditor they said...uhm, no we didnt report 09' lates and how did they verify 03' lates when WE can't even look that far back????.

Just wanted to say, you arent alone in your frustration...thats for sure..

You don't have to keep bumping your thread. Unless you're prepared to sue the CRA, you can't force them to do anything. I'm not sure what sort of advice you think anyone is going to be able to offer you?..

Wait until 45 days is up and send an ITS. Hope that they fold and delete or be prepared for litigation...

Send a letter to them and the FTC saying they are out of compliance and per FCRA laws they must delete the disputed items...
